    My retired 'School Principal' wife is NEVER unarmed.

    She believes in 'emptying-the-mag' if she ever has to draw it for real... and practices that way. She also wants a peaceful retirement.

    Next week, she is attending a tactical sidearm class she has signed up & paid for.... she thought it would be "Fun".

    So, in Texas, what is the statute regarding use of force with fleeing felons?


    Kudos to the folks for surviving the situation. Of course, his chasing down the felons shows what can easily happen if they turn to refuse you: a deadly firefight, with innocents around who are put at risk from the mayhem. Not for the faint of heart, that sort of thing. Not my choice, either, generally speaking. Though, he's got a point, when he says it's highly unlikely they'd have been apprehended otherwise. The Dalton Gang wouldn't have come to its demise, either, had the citizens in Coffeyville (KS) not stood up and said enough is enough.

    In Texas, shooting fleeing felons is allowed... I tend to call it the "He needed killing law"

    It is, as you point out, a potentially dangerous situation; especially against multiple perpetrators...

    My gut tells me the old guy was WWII vet or retired LEO... And, in my mind the former... At least since it wasn't Guantes... A self confessed "meat eater" of a LEO, whom I miss round these parts...

    Be careful with that comment "In Texas, shooting fleeing felons is allowed... " That is not entirely true. Shooting anyone AFTER the crime is a slippery slope in any state.

    The Texas statute is quoted below:
    PC 9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is justified in using deadly force against another to protect land or tangible, movable property:
    (1) if he would be justified in using force against the other under Section 9.41; and
    (2) when and to the degree he reasonably believes the deadly force is immediately necessary:
    (A) to prevent the other's imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime; or
    (B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property; and
    (3) he reasonably believes that:
    (A) the land or property cannot be protected or recovered by any other means; or
    (B) the use of force other than deadly force to protect or recover the land or property would expose the actor or another to a substantial risk of death or serious bodily injury.

    My personal interpretation is that you'd darn well be able to defend 9.42 (3) (A) and (B) also.

    But I will admit that "He just needed killin'..." might cross my mind in this situation...
