    CA: Home invader shot, dies at hospital

    San Jose: A homeowner called police after a man tired to break into his home and fired at the homeowner. Homeowner shot the intruder, who ran to a car and left the scene. Perp shows up at hospital with GSW, dies.

    The "feel" of the article is that Police treating it as a homicide (criminal). "Alleged" self defense...

    Homicide can be justified. Although this is Northern California so who knows what the cops are going to decide or for that matter what some crazy anti-gun DA might decide.

    Anytime a person is killed it is a homicide, in this case it will more than likely be classed as a justified homicide.

    I think (and only think) it wil be a homicide even if the resident did act in self defense. The get away driver may be charge in the "homicide", not the home owner.

    I am not familiar with California law but here in North Carolina his accomplice could be charged with murder since his actions resulted in the death of his partner, hopefully California has a similar law.

    Clearly, the physical evidence at the scene should show a shot in some wall (or whatever) from the assailants, if they indeed fired upon the resident, as well as the shot(s) fired by the resident. Might not, but if they exist then it gets all but impossible to claim the resident didn't have cause to defend against that attempted murder of him. Still, it's California and in the S.F. Bay area region. You never know. A zealot anti-gun DA is about all it takes to twist things all out of proportion.

    If as reported in that article, I agree it sounds like utterly justified actions on the part of the resident. After all, this isn't England.
