Wife charged after husband shoots lover

I just ran across this story involving a defensive shooting, and it's a weird one. Evidently the Tracy Roberson invited her lover, Devin LaSalle, over to have sex while her husband, Darrell, was out. Darrell came home and found them in flagrante delicto. Tracy falsely claimed that LaSalle was raping her, leading Darrell to shoot and kill him. The wife is now facing a manslaughter charge.

The really interesting bit is that the grand jury refused to indict Darrell Roberson, despite the fact that the true facts clearly didn't support the use of deadly force. Unfortunately, the article doesn't elaborate much on that angle (I guess the AP thinks the "husband shoots wife's lover, wife charged" bit is is the man bites dog portion of the story). I'm guessing that the argument was that a reasonable person would have believed that LaSalle was committing a forcible felony justifying the use of deadly force (the article also makes it sound like LaSalle was shot while trying to drive away, which would be questionable no matter what the circumstances).

One thing's for sure...It's like crying wolf. She's falsely screamed rape, and someone died over it...No one will ever come to her aid again. Hope the real thing doesn't actually happen to her in the future, because most likely no one will come.

Intead of shooting the guy he should have collected some money.

She did the equivalent of screaming 'Fire!' in a theater.

I'm surprised to see the state dropped charges completely against the husband, even as they should've, and I'm not at all surprised that the wife is being held accountable for her own very wrong actions.

That's CNN's take on it. Evidently Texas law doesn't hold you responsible if you believe you are right with the information you have at the time. Which sounds pretty common sense to me, especially in this situation.

The few Grand Jury member quotes in there basically show that they weren't going to charge him regardless.

I hope she gets the 20 years plus the 6 months for making false report. Wish she could get more than that.

Bad thing is the husband is going to have to live with the fact that he killed a man who was asked by his own wife to engage in the activity. I just hope that he is able to deal with it and get on with his life. Would be curious to know if they had any children.

Situation stinks.

I hope she gets a long jail sentence!

Well,
With her behind bars, it should be easy for him to divorce her and come out ahead. He should be able to start a new life with her away. Hopefully, his will not be the two loving arms she returns to when she exits from behind bars.
