Wife charged after husband shoots lover
I just ran across this story involving a defensive shooting, and it's a weird one. Evidently the Tracy Roberson invited her lover, Devin LaSalle, over to have sex while her husband, Darrell, was out. Darrell came home and found them in flagrante delicto. Tracy falsely claimed that LaSalle was raping her, leading Darrell to shoot and kill him. The wife is now facing a manslaughter charge.
The really interesting bit is that the grand jury refused to indict Darrell Roberson, despite the fact that the true facts clearly didn't support the use of deadly force. Unfortunately, the article doesn't elaborate much on that angle (I guess the AP thinks the "husband shoots wife's lover, wife charged" bit is is the man bites dog portion of the story). I'm guessing that the argument was that a reasonable person would have believed that LaSalle was committing a forcible felony justifying the use of deadly force (the article also makes it sound like LaSalle was shot while trying to drive away, which would be questionable no matter what the circumstances).
