    A person is justified in the use of deadly force, if such person reasonably believes deadly force is necessary to prevent imminent death or great bodily harm to such person or a third person.

    The whole reason you pretty much have to shoot the BG in this situation is that he may well just come back at you to try to struggle for the gun again, and if he gets it back, you can be sure you're getting shot to death.

    Why should something like that even have to be explained to anyone?

    The Sheriff there, Harry Lee, is a pretty interesting character, and has been sheriff for a long time. I read that during Katrina he commandeered a local WalMart and required that it stay open for needed supplies. Some of his other "colorful methods" regularly make the local news, he's no stranger to controversy. His advice below is probably not what he really thinks, but the typical CYA statement. Here's a little bit more on the story:

    Sylena Rhodes, a corporate officer for Arby’s, said, “He saved his mother’s life. He’s a hero. He’s an absolute hero.”

    While acknowledging the gamble succeeded, authorities stressed that it’s safer to cooperate in such a case.

    “Give them the money and give them the keys,” Sheriff Harry Lee said. “You make an insurance payment on your car, and nobody gets shot.”

    Maybe it's that I just made a relationship with an attorney for the just-in-case scenario I have to use my CCW in a self-defense situation.

    But here's something for non-carriers, whether or not they have a CCW permit: better get a lawyer now who will come to defend you for exercising your right to self-defense. You never know the when you might need legal counsel (or is it council?), like at Wal-mart, or the theater, or at a drive-through, or at home.

    The kid demonstrated that just because you've got a gun doesn't mean an unarmed individual can't take it away from you. The fact that the kid was the one in control of the gun at that moment doesn't mean the fight was over or the threat was gone.
