    A 44-year-old man who was trying to rob a teenager and his mother in a fast food drive thru was shot several times after the teen grabbed the gun from him and fired back, according to Jefferson Parish Sheriff Harry Lee.

    The incident occurred around 1:30 a.m. at the Arbyís drive-thru located at 3845 Veterans Blvd. in Metairie.

    According to Lee, the victims were in their car waiting to place an order when 44-year-old Carl Chestnut of Kenner walked up to the vehicle and pointed a gun at them.

    Lee said Chestnut tried to get into the car and was attempting to pull out the 53-year-old mother when the teen fought with him over the weapon, grabbed it away and then fired several times, striking Chestnut.

    Chestnut was hit in the head and torso, but the injuries arenít believed to be fatal.

    And the DA's office is still not sure if charges will be filed against the teen...who saved his family from the attempted hijacking?

    The DA should be charged with stupidity...

    He probably just wanted directions to the nearest sheriffs department to turn in a gun he just found on the street.......poor guy.

    This kid is a true hero. Whats with the DAs office. This looks like a perfect case of self defense.

    If they make an issue of it, the issue will be that once the bad guy was disarmed he no longer posed a threat making it unnecessary for him to be shot.

    How selfish can the kid be to protect his mother, I mean I'm sure the 44 yr old was just trying to get a date with his mother and the kid just got jelous.


    I couldn't even imagine there is any question a teen vs 44 yr old, the level of force the the criminal still could have against the teen should be sufficient for the kid to be able to claim he was fearing for his life.

    The town should concider the kid a hero and his mom should be proud of him. Not even contemplate charges.

    Now what would make the prosecutor think the BG didn't have a BUG?

    LEO's are taught during frisk/search, if they find one weapon, keep looking as there is a high probability more than one will be found!

    You pointed out the difference. LEO's will search for an additional weapon, they will not shoot someone because they may have one.

    The kid may have still felt threatened and within the BG "kill zone" Sounds very much like he did the right thing.


    Remember how the anti's always say "they just take it away from you" Well now you can tell them this story!
