    TACOMA, Wash. (AP) - Pierce County prosecutors have declined to file charges against a 21-year-old man who fatally shot another man at a Puyallup gas station.

    Prosecutors say the shooter was justified when he shot 23-year-old Nicholas Cruz, of Eatonville, on October 7 at a Shell station.

    The shooter told investigators he was sitting in his car at the gas station when Cruz approached and punched him several times, reportedly after breaking the driver's side window.

    Police say the driver has a valid concealed weapons permit. The man pulled out his .357-caliber handgun and shot Cruz twice.

    The men apparently were involved in an altercation of some sort before the shooting.

    Cruz had a 3-year-old son.

    Cruz had a 3 year old son! I hear he was in line for father of the year before he was brutally gunned down by one of those self defense fanatics.

    He should have been home with his son, not attacking someone at a gas station.

    You may have noted that the shooter had a prior altercation with Cruz and was attempting to leave when Cruz then persued and escalated the problem thereby paying the price.

    Sounds like a common sense No-Bill from any reasonable Grand Jury. Simply a fatal mistake in victum selection. Darwin was RIGHT!

    Yeah. When's the last time you heard of an American with a hispanic last name?Good lord. My wife's family is Mexican and they've been US citizens for almost 100 years longer than my family. For that matter how many illegals do you think are named Nicholas?

    The Pierce County Prosecuting Attorney’s Office will not file charges against a 21-year-old man who fatally shot an Eatonville resident at a Puyallup gas station earlier this month.

    Prosecutors have determined that the shooter was justified when he shot Nicholas Cruz on Oct. 7 at the Shell station at 502 37th Ave. S.E.

    The shooter told investigators he was sitting in his car when Cruz approached and punched him several times, reportedly after breaking the driver’s side window.

    The driver, who has a valid concealed weapons permit, pulled his .357-caliber handgun and shot Cruz twice, police reported.

    The two apparently were involved in an altercation of some sort before the shooting, police said.

    The man waited in his car until police arrived, according to court records. He turned over his gun and car and was released while detectives conducted their investigation.

    Harold Cruz, the dead man’s father, said Tuesday that his family still has questions about the case.

    “It doesn’t seem like to us that it was thoroughly investigated,” he said. “We want to know the truth, even if it hurts.”

    The family has hired a private investigator to look into the matter, Harold Cruz said.

    Nicholas Cruz, 23, left behind a 3-year-old son.
