Clerk shoots suspect during botched heist
    Friday, November 09, 2007

Police said they followed a trail of blood to capture a city man who was shot by a convenience store clerk during a botched robbery attempt yesterday morning.

The clerk had been pistol-whipped during the crime, and had a cut to his head, said Detective Bureau Capt. Robert T. McFarlin. The clerk, a 44-year-old native of Iraq, will not be charged, he said.

As described by police, two males entered Wheeler's convenience store at 597 Dickinson St. around 11:20 a.m. One had a stun gun and the other a semi-automatic handgun. A struggle ensued, and the clerk took the handgun and shot one of the suspects in the leg.

Police followed the blood and found Abraham Ramos, 20, of 227 White St., in a garage at 146 Draper St., McFarlin said. He was taken to Baystate Medical Center where he was being treated for a gunshot wound to the leg.

Ramos was to be arraigned in Springfield District Court after he was released from the hospital on charges of armed assault with a gun with intent to rob, breaking and entering and assault and battery with a dangerous weapon, McFarlin said.

Police are still searching for the other suspect.

Too bad the clerk got pistol-whipped, but at least he was able to turn the tables on the BG's. Also too bad that his aim wasn't a little better.

Something to keep in mind: turnabout can just as easily happen to us, when defending ourselves. If the BG is within contact distances, it's entirely possible to be disarmed.

Some stupid lawyers may try to use the line:
"They weren't trying to kill you. They showed that by hitting you with the gun instead of shooting it, and since they weren't trying to kill you your life was not in danger - so you had no right to respond with deadly force."

We were warned of this potential scenario in our CC class.

Does he get to keep the gun?
