    Man killed entering wrong apartment - Breaking News from The Huntsville Times - al.com

    A Huntsville man was killed early today when he entered the wrong apartment and was shot by its resident.

    According to Huntsville police spokesman Wendell Johnson, about 12:07 a.m. north precinct officers were called to a shooting at 1002 Webster Drive. When they arrived, they found the body of Gary Lee McCarty, 34, at the rear of Apartment B.

    A preliminary investigation by the major crimes unit showed McCarty had been drinking and locked himself out of his apartment.

    When McCarty tried to crawl through the rear window of what was the wrong apartment, he was fatally shot by the resident who thought McCarty was a burglar, Johnson said. The resident's name was not released.

    Charges were not filed against the resident, Johnson said.

    The evidence will be presented to the Madison County district attorney's office to be considered by a grand jury, Johnson said.

    This almost happened to me, my daughter left the front door unlocked when she went to school, wife and I still asleep.

    A woman came in the unlocked door, I woke up from the noise, knowing my daughter was gone, I grabbed my gun and went to investigate.

    We caught each other by surprise. Turns out she was a new cleaning lady at the wrong house, she was supposed to be next door, they left the door open for her.

    Lucky I didn't see her as a threat. Too bad I woke up, I could have had a house cleaning.

    I'd rather be caught by suprise, and getting whacked by a mop then getting caught by suprise and getting shot by a firearm....

    Se was very lucky, guess you were too since it wasn't a BG with "criminal intent."

    the point that i went to the wrong house.

    I feel sorry for the homeowner who shot the drunk. Now he/she has to live with the knowledge of what happened.

    No matter what the circumstances, the homeowner is still a victim and will have the scars for the rest of their life.
