    Store Owner Kills Would-be Robber

abc13.com: Store owner fatally shoots suspected burglar 2/07/08

[quote][i]t happened on Reveille and Bradford in southeast Houston. The owner heard someone trying to get into his business at midnight. He went outside with a gun and caught a man trying to steal a trailer parked behind his business.

The would-be thief then tried to run over the business owner with his truck and the business owner fired back through the truck's rear window.

Despite being shot, the suspect kept driving his truck for three blocks until he fell out of his truck and died on the road.

Police officers also found tires in the back of that truck, which may have been stolen.

be interesting to see where this one goes, even though bg tried to
run over store owner. i don't think i would shoot at since,
    1)b.g. is fleeing,threat over(hopefully)
2)dead bg falls out of truck. is the truck still moving? could be a promlem.
and for that reason,i would not fire.

The fleeing part isn't a problem in Texas. You can use deadly force to keep someone from fleeing with your property.

If the BG was trying to run the victim over, regardless of whether he was in the process of fleeing or not, in any state, I think the victim would be justified. I may be wrong but even in the more limited definitions of State Laws, lethal force is appropriate until the threat ceases and in this case trying to run the victim over is an obvious threat to the BG.

I'm guessing that since he was trying to load a trailer that it is possible the BG tried to BACK over the victim. Maybe I misread but if that is the case does anyone think it isn't a clear cut self defense shoot.

    Hey Hey !!

Man, you people in Texas have really gotten into the law they just passed for ya. This slug also got a case of road rash the he will never heal from. That is what happens when someone tries to take what is not theirs. Get the owner a new box of ammo.
A person is justified in the use of deadly force, if such person reasonably believes deadly force is necessary to prevent imminent death or great bodily harm to such person or a third person.

Another robbery gone good!! Sure is taking those thick headed criminals a long time to figure out that doing crime is a quick way to get yourself killed!
But,,,,,,,,,,, just think how much money the taxpayers will save not having to house, feed and clothe the sorry sucker. YESSSSSS!!!!!

I just so love it when a A**hole gets wasted. It makes our court system so much more efficient. ( Oh wait they did not need the courts).

    Through the back window?

I love my truck, but it ain't worth killin somebody to keep.

I will shoot (on the run) if you try to run me down, but once you turn away, you get away.

Besides, what if I hurt my truck? I'd feel terrible...
