Fatal shooting by boy, 13, appears to be self-defense

VISALIA -- Authorities said today that a preliminary investigation in the shooting death of a Visalia man by a 13-year-old boy appears to be self-defense.
Visalia Police Sgt. Ernie Villa said officers responded to the 1400 block of South Thomas Court around 5 p.m. and found Joe Ray Martinez, 38, laying in front of a home with a gunshot wound. He later died at the scene.
Villa said a physical fight began at the home between Martinez and his common-law wife. The wife's brother got involved in the dispute and Martinez struck him in the head with a gun and then pointed the weapon at several other onlookers, Villa said.
At that point, Villa said, the teenager came outside and shot Martinez.
Villa said police have come to the home several times in the past for domestic violence calls.
The boy was not arrested but the case has been sent to the Tulare County District Attorney's Office for further review.
