Fatal shooting by boy, 13, appears to be self-defense

VISALIA -- Authorities said today that a preliminary investigation in the shooting death of a Visalia man by a 13-year-old boy appears to be self-defense.

Visalia Police Sgt. Ernie Villa said officers responded to the 1400 block of South Thomas Court around 5 p.m. and found Joe Ray Martinez, 38, laying in front of a home with a gunshot wound. He later died at the scene.

Villa said a physical fight began at the home between Martinez and his common-law wife. The wife's brother got involved in the dispute and Martinez struck him in the head with a gun and then pointed the weapon at several other onlookers, Villa said.

At that point, Villa said, the teenager came outside and shot Martinez.

Villa said police have come to the home several times in the past for domestic violence calls.

The boy was not arrested but the case has been sent to the Tulare County District Attorney's Office for further review.

It's unfortunate that a 13 year old had to go through this but give the young man credit, he defended himself and his loved ones and I hope he finds a way to move on and live a normal life.

But the jerk he shot obviously cared little about how his own actions were effecting others and he is probably frying in hell right now with little concern about the life of that boy. The kid did the right thing.

So by California law, it is okay to shoot someone in the yard, outside the house. No "He's wrong, the threat is gone" garbage.
My point is that we don't jump on someone if state law supports their actions and that we don't denounce some states laws in a public forum, thereby, aiding and abetting the pro-crime(anti's) in their quest. While we all have opinions, to fight and bicker over a states laws is counter productive to our purpose here.
The kid stopped the threat. Good for him!! Inside or outside the house makes no difference so there should be no hard and fast rules because obviously the threat continued outside. Hopefully other kids will take charge when necessary and be an example to the rest of our kids who just comply with a criminals orders to go in a room and get down on their knees and other things. If a thug tells you to get on your knees, go into a 3 point stance and tackle him and hopefully some others with you will swarm the thug and get control of the situation.

I'd be curious to know if the kid had been trained to use the firearm by his parents or whatnot..
