BAD! Fashion Police ADW
partial quote: "[John] is accused of shooting [David] after telling him to pull his jeans up. ... Several witnesses told police [John] followed [David] into the courtyard from the pool telling him to pull his pants up. The two began to argue, and [David] pushed [John] before being shot in the stomach, according to the arrest report. ... [T]he bullet is still in [David's] side but the doctors say he’ll be fine. [David] said he had never seen the man and knew his shorts were sagging. He said he pulled them up, but [John] said it wasn’t enough and just kept coming. So [David] pushed him off and tried to walk away. ... John C. Constantin, who lives at the Westside apartments, was charged with aggravated battery with a deadly weapon. According to the arrest report, he told police it was self-defense after he was assaulted for telling Mitchell to pull his pants up." story here
{I don't know these people, but reading with names seems so much more personal.}
Self-defense, maybe, but the concept of proportional force seems not to have been applied. A shove is escalation from words to physical force, but I don't see it as life-threatening. If the fashion faux pas was walking away, why follow? Apartment complex pools are gated.
Maybe there is some medical ambiguity in declaring leaden dust from China a health threat but 115g in your body no big deal, and I'd like to form a pun about 'crack' but it escapes me, as this is just not funny.
BTW, Duval/Jax is once again the murder capital of Florida. And people up there wonder why I carry?

This guy was looking for trouble. While the kid bears some reponsibility for going hands on, the shooter deserves whatever he gets.

agreed
'self defense' for a shove (when armed) is to get out of arm's length.
two steps back would have been a major step forward in this confrontation

Agreed with you guys.
David was a victim here all the way around.
Throw John under the jail.

I agree with the shooter as far as I also am tired of seeing people wear their pants around their knees, but that did not give him the right to escalate the situation to the point that it got physical. I hope he gets a very lengthy sentence for his ignorance.

I like watching the junior thugs with their pants around their knees. It makes it easier for the police to catch them in a foot chase!

Not sure if this idiot was carrying legally or not. If he WAS carrying legally he is responsible for giving the rest of us who carry responsibly a bad rep.
I don't like to see some punk with his pants around his knees anymore than the next guy, but that IS his right just as its MY right to protect myself.
The shooter deserves what he gets for sure.

"John" carries a gun, plays fashion police, then attempts to murder someone who refuses the bullying (and keeps walking away from the aggressor).
He's about to find out just how "fashionable" dropping one's pants can be. Pucker up, sport.

Constantin is an idiot and should be charged with that along with everything else he will be charged with. Just goes to show you can be stupid at any age.

The first rule of self defense is you must be without fault in causing the altercation. Of course John was at fault in following, initiating the altercation and causing the altercation all together. Had he not decided to CAUSE the altercation it would never have happened.
So John cannot claim self defense. Simple as that. He is going to Jail.

We don't. He apparently would have benefited by one.

One of them would have flunked the boots and urine test.
