    CAPRON—An ongoing case of domestic violence turned bloody Monday morning, when a man was shot in the shoulder by his former girlfriend after he allegedly broke in to her Capron home, police said Tuesday.

    Derrick Edward “Rick” Miller, 43, formerly of Brandy Pond Road in Capron, is recovering from a gunshot wound at a hospital in Greenville, N.C.

    According to Detective Cpl. Richard Morris, spokesman for the Southampton County Sheriff’s Office, Miller’s ex-girlfriend shot him with a .357 Magnum when he allegedly tried to attack her after breaking through her front door early Monday morning.

    He then left the scene and went to Como, N.C. From there, he was transported to an Ahoskie, N.C., hospital and then flown to the Greenville medical facility for further treatment.

    The woman called police at 1:42 a.m. to report the alleged break-in and the shooting.

    Police have charged Miller with breaking and entering in the nighttime and violation of a protective order in connection with Monday’s events, though warrants have not yet been served, Morris said.

    Monday’s incident was the second in as many days involving the couple.

    Morris said police had been called to the scene Saturday afternoon when the woman reported that she had been assaulted. Police issued, but have not yet served, two warrants in that incident — one for domestic assault and one for unauthorized use of a vehicle.

    A “history of domestic abuse” had resulted in the court issuing a protective order against Miller prior to either of the recent events, Morris said.

    She missed.

    She is going to have to keep both eyes open, for a long time, seemingly. I don't imagine this guy's going to like having been thwarted, shot and "dissed" by his ex. Like as not, he'll retaliate, court papers or not.

    Assuming the story's accurate, kudos to her for standing up for herself. Another example where hopping on the telephone (to call 911) wouldn't have saved her, in which case she could have ended up just another raped, bludgeoned piece of meat left for the neighbors to find. Instead, she opted to take charge of her own security and thus had a chance. Smart.

    Good on the lady. Wish she could have double tapped the scumbag on the wishbone. Those orders of protection are as useless as the paper they are written on.

    Perpetrators of domestic violence need to be summarily executed on the spot.

    Thankfully, the victim had the tools and ability to at least try.

    If it was a .357 Mag, and not a .38 Spl loaded in a gun chambered for .357, we know the bad guy had a BAD day, at least.

    When will people realize protective orders, like any other law, will only be observed by law-abiding citizens. The dirtbag population will only use the protective orders to wipe.

    But........ There was a protective order!!!!! Maybe he hadn't been served yet so he didn't know about it. That has to be it. Yeah! If they had served the order on him sooner this never would have happened!

    Shot placement is everything,shoot til the threat is stopped,when this guy gets out of prison he ain't gonna be happy,guys like this don't know what no means and don't like getting dumped they feel like they own the other person and if they can't have them nobody will.

    In this case, rather than stopping the threat, I am afraid she has only delayed it. This ugly situation is not over. I don't think this guy will stop until he's dead.
