    Business Owner Takes Crime Problem into His Own Hands


    A suspected copper thief is dead and Garland police said they are not filing charges against the shooter.

    The shooter is the owner of Bargain Town in the 5700 block of Broadway Boulevard.

    Police confirm the owner's claim that the business has been hit several times by copper thieves.

    The owner decided to try and stop the thefts, so Wednesday night he was waiting on the roof of the business with a gun.

    Around 1:30 a.m., a man reportedly climbed up onto the roof and the owner told police that there was a confrontation between him and the suspected thief.

    The owner shot the man during the confrontation, according to investigators.

    After being wounded, the thief jumped off the roof and tried to run away but he collapsed in the parking lot and died on the scene.

    Police said the business owner is cooperating with the investigation.


    The bad guy wanted copper and he got some, wrapped around some lead.

    Uncertain where this occurred. In some states, "lying in wait" laws brand the victim (of the intrusion) as felon for doing so (lying in wait). Though, I'm assuming he had his wits and was defending against the violent attack that ensued once the intruder was caught out.

    heck with that kind of law you could make an argument that being armed in your home prior to a home invasion that you were lying in wait when you shot the invaders.

    Hum....

    I was unaware that "lying in wait" was a crime, in itself.

    I thought it was a "special circumstance", "aggravating circumstance", etc once murder was established.

    If a shooting is otherwise righteous, how would "lying in wait" be a factor?

    Anyone have a citation for a case or statute?

    Defending your business or home is not laying in wait,Here in Texas all you have to do is try stealing after the sun goes down and you become an instant target.There will not be a trial with a buncha tree hugging people skeered of guns,Being a thief in Texas is more hazardous then fishing for Alaskan King Crab
