DC Rejects Heller application (again)
Unreal...
WUSA9.com | Washington, DC | DC Rejects Handgun Application
"WASHINGTON (WUSA) -- District residents can start registering their guns today. But at least one very high profile application was already rejected.
Dick Heller is the man who brought the lawsuit against the District's 32-year-old ban on handguns. He was among the first in line Thursday morning to apply for a handgun permit. "

It isn't bottom loading if you're doing a 7-11 gangsta style over the counter shooting.
4th ammendment?? What's that guy talking about or am I missing something?

How stupid could they be? They were ordered by the Supreme Court to issue Heller a license. And to call a 7+1 round Semi-Auto a Machine Gun is just stupid.
So, does the D.C. Police carry revolvers or machine guns for their normal duty?

"A spokesman for the DC Police says the gun was a bottom-loading weapon, and according to their interpretation, all bottom-loading guns are outlawed because they are grouped with machine guns."
So does that mean you can only have a revolver in D.C.?
And that post by SBR85 is classic
dribble, I hope he changes his mind after he is robbed (providing he makes it through it).

I'd like to see the media report on a LEO firefight in DC and say, "cops gunned down the suspect with their machine guns."

He's saying that we wouldn't stand for letting the city/district restrict and regulate our 4A rights in a similar manner.
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
In other words, "you don't have a license against unreasonable search and seizure so I'm coming in your house to search with or without your permission."
It's a stretch but he's trying to make a point.

HE'S missing something - a brain. The 4th amendment and the 6th amendment are both non-issues in this dogfight. The guy just wants to sound like he knows something.
This is especially apparent in the way he talks about how having a gun in the home increases the chances that a family member will be killed or injured. That's old stats and irrelevant to the idea that (according to the opinion in Heller) that handguns are the preferred method of self defense for most Americans. Just because handgun violence exists does not trump a person's constitutional right to possess that firearm.
IOW, he's an anti with a screw loose and bad logic/reasoning/argument.
I smell another lawsuit from Dick Heller which will challenge the new regs on the basis that they are unduly burdensome and the rejection directly violates the decision in the opinion which said that the district MUST issue Heller a permit.

Thanks for the clarification.
Anyone think for a minute that Heller might be tired of the fight? Wonder if he'll roll over and get a revolver and hope someone else will take up the battle. It had to be tough going thru it the first time and then go after it again.

Yup, saw this one coming. The more complicated their actual decision is, the more open to "interpretaion" (aka infringement) it is.
Here's what the "High" Court should have said:
"From now on,
all weapons of every conceivable type are hereby legal to all who have not been convicted of a felony and are of voting age. Further, the registration of any weapon of any kind is unconstitutional for any reason at any time. Any politician defying this ruling will be dragged to the mall in DC and hanged in public for treason and crimes against the Constitution."
Additionally, any politician referring to a firearm as a "bottom-feeder" is clearly a case of the pot calling the kettle black.
I can't believe what a bunch of
we are that no one is rioting in DC's streets over this. Back in the day it only took a few cent tax on tea... God help us.

I don't think Heller team is tired of this fight yet. It looks to me like this is a calculated tactic on the part of Mr. Gura and his legal team. Think about it. USSC ordered DC to register Dick Heller's handgun, and his handgun is 1911 with 7 round magazine. Outside DC's unusual interpretation of a machine gun, no-one, not even hard core anti state bans 1911. 1911's are probably as "in-common use" as handgun can it get. I bet Heller team is trying chip away at DC's new gun law, in attempt to corner them into check-mate.

Why would Heller even bother considering this new law is just as restrictive?

Thank God they haven't seen the Jerry Miculek video! If the DC Police see that video you can count out any moon clip fed revolvers. The new Term will be it will be illegal to posses and "Revolving Machinengun Bullet Launcher" fed by a Circular clip, able to be inserted all at once with only one hand!!!!

Sadly, no it's not. It's all semantics.
You have gone from NOTHING to being allowed a revolver, and that is exactly what they will tell you. You now have the right (?) to own a handgun............. As long as it isn't a semi! Guess that's going to be the next court battle, and it will probably be harder to win.
