Homeowner Dies After Shooting Suspected Thief

KALAMAZOO -- A homeowner died early Sunday after struggling with and shooting a man he caught breaking into his car in the Milwood neighborhood, police said Monday.

The 64-year-old, whose name was not released, suffered a massive heart attack after the incident, according to the Kalamazoo Department of Public Safety. He was later pronounced dead at a local hospital.

The suspect in the car break-in, a 38-year-old Kalamazoo man, was admitted to a local hospital to be treated for a gunshot wound to the leg, a news release said. He was in stable condition this morning, Capt. Jim Mallery said. As of this morning, he had not been arrested.

Public-safety officers went to the house in the 1300 block of Homecrest Avenue at about 4:05 a.m. Sunday after receiving a report that a person was being detained after a homeowner found him breaking into his vehicle. Police said the suspect was shot after a ``physical struggle'' in the driveway.

Mallery declined Monday to say whether detectives had recovered a weapon in their investigation. He said investigators plan to submit their investigation to the Kalamazoo County Prosecutor's Office for review no later than Wednesday afternoon.

This was just on the news tonight. Kalamazoo is the closest "big" town to me. I umpire little league games in the Milwood area. And AFAIK he will be facing murder charges. Too bad we'll just have another person taking up space in our jails...

I think that's standard procedure. If the dirtbag is in custody, then the state is responsible for his medical care; they'll just place a few cops outside his hospital room door, and arrest him once he's discharged from the hospital.

Sad, the old guy won the battle but lost the war.

Manslaughter charge authorized after homeowner dies of heart attack following struggle during alleged robbery

KALAMAZOO -- Manslaughter and robbery charges were authorized Tuesday against a man who was shot in the leg by a homeowner who then collapsed and died of a heart attack.

Jeffrey Robert Chapman, 38, of Kalamazoo, faces one count each of manslaughter and unarmed robbery following an early-morning incident Sunday in Kalamazoo's Milwood neighborhood.

Kalamazoo Department of Public Safety investigators have said 64-year-old Joe Rizzuto suffered a massive heart attack after struggling with and shooting Chapman.

Rizzuto had caught Chapman breaking into his car outside his home in the 1300 block of Homecrest Avenue at about 4:05 a.m. Sunday, police said.

Chapman remained hospitalized in stable condition Tuesday afternoon as Kalamazoo County Prosecutor's Office authorized the two felony charges, both of which carry up to 15 years in prison.

The gun used to shoot Chapman was registered to Rizzuto, who had a permit to carry a concealed weapon, according to Prosecutor Jeff Fink.

Rizzuto's wife said the incident Sunday began when her husband, who was watching TV in their living room, woke her and said someone was in their backyard. After getting out of bed, Jean Rizzuto said, she found her husband outside with his 9 mm handgun, confronting a man who was inside her Chrysler.

Jean Rizzuto said her husband told her to call police and, moments later, the man grabbed him and pushed him against the door of the car. When the man started to run, her husband opened fire, striking the man in the left leg, Jean Rizzuto said.

Within seconds of the shooting, Joe Rizzuto turned to her and told her he didn't feel well, his wife said. As he walked toward their house, he collapsed. Doctors pronounced him dead at about 11 a.m. Sunday, she said.

Visitation for Joe Rizzuto is scheduled for 2 to 4 p.m. and 6 to 8 p.m. Thursday at Langeland Family Funeral Homes, 622 S. Burdick St. A funeral service is scheduled for 11 a.m. Friday at St. Joseph Catholic Church on Lake Street.
