A Kingsburg man who was shot Tuesday by a homeowner was booked on robbery, burglary and methamphetamine charges, the Fresno County Sheriff's Department said.
Manuel Ibanez, 37, was taken into custody after a struggle with deputies at the home on the 14000 block of East North Avenue, sheriff's spokesman Chris Curtice said. The shooting took place after an intruder was surprised when a woman living at the residence saw him trying to steal an ATV, Curtice said. The woman alerted a male resident who confronted the intruder and shot him in the foot after a struggle over a rifle.
Arriving deputies fought with the suspect, who was then taken into custody.

Being a member of the PRC family in good standing for most of my adult life I can say right here that if the DA wants to prosecute this home owner then that poor devil is gonna loose big time 'cuz you CAN'T use deadly force to prevent property theft in the Golden State. As a matter of fact, the perp will probably take him to court in a civil lawsuit and clean his clock. I'd've let him have the RTV and collected the insurance for a down payment of a new one. It just ain't worth it here, this ain't Texas!!

I don't think he shot him on purpose.
It sounds like the homeowner confronted the thief with his rifle but that the thief didn't believe he would really shoot him and decided to take the rifle from him. Once the thief got his hands on the rifle and tried to take it from him, it now became a threatening gesture and I'm sure the homeowner was afraid for his life.
Possibly, the shot was fired by accident in the struggle. That certainly seems to me to be what happened. And I've no doub't that the homeowner was also thinking that if the thief did manage to gain control of the rifle, that he would probably end up a dead duck.
But like was noted in a previous post, it is probably not within the law in Mexifornia, uh, I mean Kalifornia, to shoot a person over property. Just one more of many reasons why I will never live there.

Since we don't know the whole story the thief may have been stealing the rifle or may have brought it with him. The story just said the man "confronted" the thief. It didn't say with a gun. Don't read into a story what isn't said. Any way you put it, the thief has a sore foot.
