Man shot by police had prior charges
Suspect had been accused of fleeing officers before

By Kevin O'Neal and Francesca Jarosz

A man shot by police after he allegedly tried to drive over two officers Tuesday already faced charges that he bolted from police in September.
The two Indianapolis Metropolitan Police Department officers said they opened fire on French Mason after he tried to run them down in a car and escape from the scene of a burglary.

Mason, 19, was in critical but stable condition Wednesday at Wishard Memorial Hospital.
Speedway police had arrested Mason on Sept. 19 after they said he fled from them.

According to a police report, a Speedway officer discovered Mason was driving a stolen car in the 5600 block of West 25th Street. Mason fled from officers in the stolen car and on foot before a police dog caught him in the 5500 block of Hickorywood Drive, the report said.
Mason was formally charged with auto theft, resisting law enforcement, driving with a suspended license and criminal mischief.
Court records show that he was ordered held on a warrant that carried a $20,000 bond.
Then, at a Sept. 24 hearing, Judge Reuben Hill recalled the warrant. He ordered that Mason be released on his own recognizance and that an electronic monitoring bracelet be placed on his ankle. The order meant that Mason had to stay at his home in the 2900 block of Riverside Drive.

After officers subdued Mason on Tuesday night, they found the bracelet on his ankle.
Police had been called to the Brighton Park Apartments in the 1900 block of Canary Court about 11 p.m. by a resident who reported seeing several men kicking in an apartment door, said Lt. Jeff Duhamell, a spokesman for IMPD.
He said officers saw Mason and another person running from the apartment and that two officers chased them as they got into a car. Duhamell said Mason, the driver, tried to get out of a parking area and slammed on his brakes, hitting two other cars. As the officers tried to get him to stop, he gunned the car toward them, Duhamell said.

The officers fired several bullets, hitting Mason in the eye and knee. Duhamell said Mason continued to try to escape the parking area until a third officer pulled his patrol car in front of the vehicle and blocked it in.
Mason fought with officers as they came up to the car, Duhamell said. He said they tried to subdue Mason with an electric jolt from a Taser but had little success because he was wearing a bulletproof vest.

Mason was arrested on preliminary charges of burglary, resisting law enforcement, using body armor in a felony and driving on a suspended license. The other person in the car, a 17-year-old, faces charges of burglary and conspiracy to commit burglary.
Mason's is the eighth police-action shooting this year and the third this month. Three of the shootings have been fatal, including one this month, said Sgt. Matthew Mount of the IMPD.

Duhamell said that, under department policy, the officers involved will be placed on administrative duty while the incident is investigated.

September: grand theft auto, resisting, driving with a suspended license and criminal mischief. Released on own recognizance.

Tuesday: home-invasion, fleeing arrest, assault on officers with a deadly weapon, wearing a bullet-proof vest during commission of felonies.

Penalty, so far: Police who arrested him are removed from active "beat" duty and are now driving a desk, reducing coverage in town until this guy's dealt with. Likely, he'll get two bracelets, now, all the better to monitor his actions. He'll need that second bracelet, 'cause the first doesn't seem to have been working very well.

Perhaps I'm being a bit harsh, but no wonder it's called a legal system and not a justice system.

Lesson for citizens: Beware of the new tactic, of criminals wearing vests and other armor to defeat defenses.

Arn't judges elected positions for the most part?

I wonder how this will turn out for 'our' judge as well?

I'll never understand why they try to save the lives of these dirt bags. Just let them die... It's cheaper for the taxpayer and that way he won't get off the hook to commit another crime.

Head shots should be practiced every time you go to the range.

A shotgun is a good choice for barricaded home defense.

I'm so surprised, I thought ankle bracelets helped BG's become model citizens. He should be dropped with a rope bracelet around his neck. Shot in the eye and still put up a fight? Why taser? Save the tax payer some $$.

The ridiculousness of this man's sentence is beyond any logical thinking. He sould have a bracelet in a cell.

It is a justice system only if you are a law abiding citizen, OK, more of a freight train.

Calling it a legal system for seasoned/repeat criminals is a stretch, more like day care.

Most judges are appointed, reality bites, and the human right activists care more for the criminal than the sheep they violate.

All I can say is the BG had alot of fight in him to still be fighting after being shot in the eye. Great shot placement by the officers though.

I agree the judicial system failed again, and the judge who let this guy out on an OR bond needs to be held responsible.
The LEO in this case did a good job. As we have said here many times, stopping the threat is the reason we carry and would fire our weapons, it may mean having to kill someone, but that is not the purpose of firing. A LEO doesn't want to live with taking another's life anymore than we would. The fact that it was a justified shooting would not make it easier to live with.
I'm surprised the charges didn't include assault with a deadly weapon on a LEO since he attempted to run them down with a car.
Hopefully the judicial system will put this guy away for a long time and keep him behind bars, but somehow I doubt it.

I bet it was an eye wound and not a shot to the eye. Probably broken glass from a round through the window.
But if you are authorized to carry a weapon, and you walk outside without it, just take a deep breath, and say this to yourself...

That's what I'm guessing too. A shot to the eyeball should've dropped him. Atleast in pain and lack of depth perception
