East Naples man holds five at gunpoint until police arrive

By Naples Daily News staff report
    6:50 p.m., Friday, February 6, 2009
    Hornan Ruiz

NAPLES — An East Naples man held five men at gunpoint on Thursday afternoon after Collier County sheriff’s deputies say one of them stole a bag of tools from his trunk.

Just after noon, the Sheriff’s Office received a call from a man who said his friend, Raymond Vannortwick, had numerous burglary suspects detained at gun point at 184 Price St.

When deputies arrived Vannortwick had 26-year-old Hornan Ruiz, 6435 College Park Circle, No. 307, East Naples, detained at the back of a Ford SUV, according to a report. Four other men, identified as Yefri Baires-Polanco, Michael Rodarte, Guillermo Rojas, and Bartolo Martinez, were in front of the SUV.

Vannortwick told investigators that he was inside his home when he heard tires screech and his dog bark, the Sheriff’s Office reported. When he looked outside he saw Ruiz wandering around his vehicle at the end of his driveway. Vannortwick has a "No Trespassing" sign at the entrance to his driveway, reports said.

Ruiz then entered his vehicle, popped the trunk and took a black tool bag.

Vannortwick ran out to confront the suspects, and scuffled with Ruiz.

Ruiz was arrested on charges of burglary, battery and petty theft.

Sounds good to me. They should all be that easy to catch.

If they decided to run and he shot them, he'd be hung. As it stands should be good.

One against four ain't the best odds, and getting close enough to scuffle is a bad tactic. I am thankful we are reading this story and not one about a man who got jumped by five guys and got shot with his own firearm.
But if you are authorized to carry a weapon, and you walk outside without it, just take a deep breath, and say this to yourself...

I don't know...can one use a firearm in Florida to make a citizen's arrest? Does this meet the castle law?

This one is a toss up that will depend on the grand jury and DA...don't know why he didn't just call the police. Could of turned ugly...

That was my first thought too...if you're close enough to fight, you're already at a disadvantage...especially if there's 4 of them!

I had thought that too. The call to the police should definitely have come before the confrontation

Sounds like a great job. Unfortunately the police/courts will probably let them back on the streets pretty soon, cuz you know the police/courts really want crime to increase and hate when it decreases.

Well, of course. If they imprisoned all the criminals then the police and the lawyers and judges would all be out of jobs. Then what would they do with their time?

Agreed...Unless of course he were in TX.

In Oregon, this would be dangerous. You can't use deadly force for a minor theft or property crime outside of your residence. Now, if they all attacked him, then he might feel that they were using deadly force against him and he could defend himself. But, you can not run out and shoot someone for breaking into your truck.

Depends on how well they sell it to the DA and jury, seems to me. If I'm reading correctly and he went out to confront them concealed so w/o deadly force. Got in the scuffle, 4 on 1, feared for his life then drew. Anti-gun/Anti-SD view on it would be "he was safe in his house, why did he go out and create/escalate the situation?" I'd call it fair play and let him off, but I'm neither a DA or anti-gun...
