    GOOD: CCW Holder Stops Thief - Lea County, NM

    LEA COUNTY, NEW MEXICO - Shot, arrested, and now charged with aggravated burglary in Lea County.

    According to deputies, 44-year old Redin Stephenson was shot last Sunday after burglarizing a pick-up on east Alabama.

    They tell us the owner of the property heard his dog barking and went to check it out.

    That's when he saw Stephenson walking away from his truck which had already been broken into the night before.

    The owner shot at Stephenson twice with a shotgun.

    Authorities found Stephenson the next day with wounds that backed the homeowner's story, and charged Stephenson with aggravated burglary.

    The property owner will not be charged in the shooting.

    I thought Texas was "special" because they allowed this type of shooting. Does New Mexico also allow this, or are the LEOs giving the guy a break? I know I'd be staying at the Iron Bar Hotel if I did this in VA.

    Castle laws maybe? I do wish we could protect our property though.

    We here in New Mexico don't yet have "castle laws" on the books.

    The news report about this incident seemed to be lacking in a few
    pertinent details. It sounded like the shooter got away with shooting
    a man who was leaving the scene of a crime, which itself is illegal
    here. So, there must be a lot more to the story than came out in the
    news.

    Sometimes it's as simple as a sympathetic DA or the political climate favors clemency. In other words, it may have gone down exactly as reported in the media but I wouldn't count on it working out that way in a neighboring county or even next week.
