    At about 6:15 a.m., witnesses pulled Darryl Milton Franklin Jr., 37, out of a car that he was reportedly breaking into in the 1100 block of Langwick Drive.

    As they waited for police to arrive, witnesses saw him attempt to break into other vehicles and even try to commit a carjacking, authorities said.

    Franklin attacked a man who approached him. The man, who was carrying a permitted concealed weapon, shot Franklin, said Houston Police spokesman Victor Senties.

    The shooting is being investigated by the District Attorney’s Office and will likely be referred to a grand jury, Senties said.
    I just wonder how the GG will come out from the investigation.

    Based on what is written, he should be ok. Another perp down, and another good citizen hopefully not hurt too badly... could've turned out far worse had he not been armed.

    Wonder how much an attorney is going to cost him to go to the grand jury? Why would they take it to the grand jury when it's totally a good shoot.

    It always goes to the Grand Jury in Texas.

    I love the GunShine State, but TX is right up there.
    TX should give awards for saving the taxpayers $$ on any BG receiving the 'dirtnap' special.

    It always goes to the Grand Jury in Texas.

    OK is a little different on this one. In the past two years our county prosecutor declined to take three righteous shooting cases to the grand jury.

    One of the reasons for going to the Grand Jury here is our civil immunity protection. If our use of deadly force is legal under chapter nine of the penal code we either don't get indicted, or if indicted get found not guilty at trial. If we are legal under chapter nine the bad guy, his family etc. can't touch us civilly
