    A south Seminole County man shot and killed a masked intruder who was trying to break into his house this morning.

    The incident occurred just before 4 a.m. in the 300 block of Magnolia Street near Altamonte Springs and both the dead man and the shooter have lengthy criminal records, authorities said.

    "It appears, on face value, that it was justified," said Seminole County Sheriff's Lt. James Clark.

    "The suspect was wearing a ski mask," Clark said. There were boot prints on the front door where he had tried to kick it in.

    Clark identified the suspect as 21-year-old Donald A. Salaam of Altamonte Springs.

    He has an extensive criminal history in Seminole County, Clark said, including charges involving drugs and fleeing from police. He was also being investigated in an armed robbery, Clark said.

    But Clayton Montford also has a long criminal record andserved prison time for cocaine possession. Montford has been arrested in Orange County at least 25 times, Clark said.

    Investigators are trying to determine if Salaam had any accomplices. "We didn't find a gun," Clark said. "It's kind of strange for someone to conduct a home invasion without a gun by himself."

    Clayton Montford, 50, was awakened by his wife, Pamela, 43, after she was awakened by the noise of the attempts to kick in the front door.

    Clayton Montford grabbed a gun and went to the door. He was confronted by the masked man and fired once, hitting the suspect in the chest. Investigators believe he wildly fired a second round as he retreated into the house, Clark said.

    Investigators spent considerable time with Montford because of the man's criminal history, but in the end decided that had nothing to do with the justification of the shooting, Clark said.

    The Seminole-Brevard State Attorney's Office will be asked to review the finding at the shooting was justified and also to decide if Montford should face a charge such as possession of a firearm by a convicted felon, Clark said.

    However, in this case the homeowner is a felon in possession of a firearm.

    IMHO, he should be charged with the possession. The shooting appears lawful, but he's still a felon with a gun.

    Which reminds us that all folks have a history, and even folks with history find it necessary to defend against crime.

    I think it also points out the fallacy of gun laws, yet again. Not unless you're committing a crime does a weapon come into play as a bad thing. Not until then. In all other situations of good/normal/upstanding behavior, it's just a tool like a fire extinguisher in anyone else's home.

    That said, though, I agree with you that he'll probably face charges for possession, if that's the law in his state.

    I disagree with you on this.. If he served his time and cleaned his act, I feel all right's should be restored.. Now if he is still using??? Different story.. Just IMO...
