    Robbery attempt victim fights back
    Posted: Jul 06, 2009 8:28 AM EDT

NASHVILLE, Tenn. - A victim of a Nashville robbery attempt fought back against the suspects.

This happened just before midnight Sunday night outside a market on Buchanan Street in North Nashville.

Police said the two suspects went up to their intended victim with a shotgun and announced the robbery.

According to police, the victim, who is a permitted gun holder, pulled out his weapon and fired.

Fifteen minutes later, police said one of the suspects showed up at a local hospital with a gunshot wound.

Police have both suspects in custody.

Yeah the second guy deserved a taste of some lead! That would have served as a negative reinforcement to crime!

Great news...another dirtbag shot while trying to rob an innocent victim.
Too bad the victim didn't get them BOTH, and with permanent solutions.

The second guy may not of been armed? I wouldn't shoot someone that was not armed and backing up?? He got the guy with the shotgun, and they both took off,. That is good,. Great outcome being they are both in jail..

Agreed Tuc, and my first thought in response to the others above.

The active and immediate threat was stopped.
In that immediate the story is now changed as a result.

If the second BG is not armed and not in the _immediate_ an active threat then there is no good reason nor lawful cause to fire on to that person singular.
Doing so would be assault with a firearm by the GG/Victim who in an instant of poor decision making would become the BG/victimizer.

Boy isn't that the truth. Surely the shotgun man was inattentive or distracted is some way. It would certainly take big brass ones to draw on an attentive holder of a shot gun trained directly on your person. I really wish the story would have examined this aspect of the successful defense.

Got a question for ya' Jang. In most/all states, if there was a homicide (BG or GG) the second BG would be charged with murder and I think it would be reasonable to assume the second guy had a gun under the circumstances, seen or not. An average shooter would still be able to fire multiple rounds in a couple of seconds. Given that, I would think it would be hard for a DA to press charges if both BG's got shot, how bout you?

I think he did OK considering it was 2 vs 1 and they had the shotgun.
