Here Is Follow Up Article To Store Owner Kills Two...

Now the poor old guy feels bad for shooting the robbers? That's really sad for him since he did nothing wrong. That's the crappy part to the whole deal for him and everyone that ever faces something like this I guess. He did the right thing. His store clerk is getting beat with the gun so he grabs his shotgun and shoots. Now he lives with personal guilt that HE SHOULDN'T because some hoods wouldn't walk away when he offered. He and the clerk are the victims, not the perps. Lastly, he should be happy and put his mind at ease. He probably actually prevented somebody else from getting robbed or killed had they taken his offer to leave. For that the citizens of New York should be thanking him!

There is a poll along with the story, 97% he was justified to shoot.

Just heard on Fox that the police will not charge him.. Justified use of deadly force.

Hope that ends his legal problems.

Hope that's true. As for ending his legal problems... I don't know. I'll bet there is some lawyer talking to the families of the "purps" about civil suits right now.

Gun owners 55% and non-gun owners 45% made up the 97% who say he was justified ! Makes me wonder WHY WHY WHY that 45% don't buy a gun ?

Yeah, maybe if you own a castle.

I agree that the shopkeeper in all likelihood saved lives, including his own (I read in one article that the BGs tried to place plastic handcuffs on some of the employees. That can reasonably be considered a prelude to an execution-style killing). People need to remind the shopkeeper of that. I'd feel bad too if I killed someone too, but imagine how much worse he'd feel if he'd done nothing and innocent people (some of his employees) had been killed and he'd had the means to protect them but did not do so?

I live in NY State. We don't have an absolute Castle but a modified one, so long as the invader clearly is a danger to life - and arson and burglary constitute that (and the NYC situation is a big step beyond that minimum) - I never heard of any charges filed or successful suits - for the presumption exists of having nowhere to retreat while under danger of death.

I do know of one case, a robber fled down the street after a hold-up (don't know if he had showed a gun or not); robber was pursued by the store owner down the public street and shot in the back. Even that wasn't a charge of attempted murder but something less (the BG survived the wounds). And the case of Gus and the 4 felons is a whole different story.

I don't think a civil suit will go anyplace - even if attempted. Take a look at the poll results. If you were an attorney would you want to take such a case? This isn't a gray-area situation to say the least.

I'd feel bad if I killed 2 people. Not bad enough to not do it, though. And not for very long, either.

include the self assured, self styled intellectualist/elitest that were polled. Any superior, intelligent, sophisticated, educated person could very well have engaged the perps in introspective dialogue resulting in submission by said perps, who would have thence forward become valuable members of society! Really cut and dry, actually.
