Victim Kills Would-Be Robber

MILWAUKEE - A 23-year-old Milwaukee man was being robbed at gunpoint when he pulled out his own gun and fatally shot one of the suspects.

It all happened early Thursday near 1st and Clarke. The 23-year-old man was walking his girlfriend home when two teenagers pulled out a gun and tried to rob them.

But the victim also had a gun. He shot and killed one suspect, 17-year-old Kevin Ollie. Ollie's gun also went off, and he accidentally shot the other teen robber before he died.

The robbery victim's family says he had no choice but to fight back.

The District Attorney's office agreed. Chief Deputy District Attorney Kent Lovern said the victim acted in self-defense and will not be charged with any crime.

But the surviving robber, Damien Cole, 19, has been charged with felony murder for his role in the incident where some died during the commission of another crime.

He could get up to 55 years in prison on that charge.

Cole also faces charges of armed robbery and attempted armed robbery.

That there is Outstanding shooting as Gunny would put it,shoot one BG and in turn he shoots the other bad guy,kinda like figuring a bank shot in pool.I think it's awesome they aren't charging the victim with carrying illegally,maybe theres a change a coming

First off. Second I wonder if he was OC or CC? Third this should show/send the message that WI needs to WAKE the $%@#@ up and start giving CC licenses out ot every non felon that wants one!

Seems like defacto concealed carry. It's illegal if we catch you but if you shoot someone in self defense, we are too chicken to prosecute you for a 941.23 violation because we're afraid it would be ruled a right.

WI is a State like Illinois, which bans CCW and does not recognize CCW from any other State!

Likewise, I am surprised he wasn't gigged on the illegal carrying of the gun.

I was also pleasantly surprised that they opted to charge the surviving Goblin for felony murder. That is great! He gets shot by his dying buddy and then gigged for his buddy's death!

It doesn't get any better than that!

Wisconsin doesn't allow concealed weapons in public. They don't issue a permit nor recognize others. Unless you are a cop or retired cop, it's illegal to carry a concealed weapon.

Wisconsin statute 941.23 is the issue.
