Convicted thief sues store he robbed

CLINTON TOWNSHIP, Mich. - The criminal is finding new and legal ways to victimize the people he ripped off and threatened to kill.

"Ridiculous," says a loyal and longtime customer of Nick's Short Stop Party Store regarding 22-year-old Scott Thomas Zeilinski decision to sue the store owner and some of the clerks after he, Zeilinski, was shot during an armed robbery.

Zeilinski is serving an 8-22 year sentence for the robbery that happened in November of 2007.

According to police and court records, Zeilinski came in wearing a mask and carrying a knife that he put to the throats of several employees, threatening to kill them before stealing cigarettes and cash. As he was leaving--reportedly still making threats--one of the young clerks grabbed a gun and shot him in the arm and back. Zeilinski's lawyer says his client is asking in excess of $125,000 for pain and suffering and emotional distress.

Since the robbery the store owner has spent thousands of dollars on security to keep his employees safe. He says he is hoping nothing like this ever happens again.

Zelinski says the incident "ruined his life" and believes the store is responsible for it.

    ====
I think the store victims held with a knife at their throats have ample grounds for countersuits. Let's hope this one gets laughed out of court.

Nick's Short Stop Party Store should have been the final place the BG patronized in his life.
I hope some of the money invested in security also covers range time.

I don't believe a Lawyer will actually represent a guy that was convicted specially
    for robbery.....with a deadly weapon..!!

You would be suprised at what a lawyer will do.

I do believe this one will find a bottom sucking piece of human pond scum to represent him. As far as the badguy having his life ruined, good. He is the victim of his own illegal acts. The only one that should be paying anything is him.

Maybe the real victims in this case should sue him. That way, if the real victims get a judgement in their favor, he can be made to pay restitution off his commissary books. It sucks to not have money and be in prison.

Lawyers, politicians and Ladies of the Evening are the world's oldest professions. There is always a lawyer that will represent anyone for anything. Nothing is too bad.

I wish every state would adopt Florida's "too bad" law.

In Florida, there is an absolute bar in the law to recovery for this sort of lawsuit. You can't stop the criminal from suing, but since he was convicted of the robbery, he could not recover a single penny.

And, he's liable for the legal expenses of whomever he sued. If he has an attorney, that attorney is also liable for the legal expenses of whoever he sued.

But since inmates don't have any money, Florida also strips all their privileges in jail. No phone, no commissary, no recreation.

I wish every state did likewise.

If this guy gets any money, I'll eat my hat.

Our legal system needs overhauling so this sort of thing never sees the light of day.

    Answer:

The defendant(s) admit each and every allegation in the complaint.

    Special defense:

The plaintiff is full of it.
    The plaintiff deserved it.
The plaintiff is lucky he lived.

    Counterclaim:

    Vexatious litigation.
    Harassment.
    Tortious interference with business.

    Signed,

    The defendants.

Do you people REALLY believe that a lawyer would waste his time on this case?

    Seriously. No $$ in it.

This kind of thing is a contingency case, and you don't get paid unless you win. Further, the judge would...it involves bricks & or kittens...when he saw a lawyer's name attached to this case.

This is a guy who has access to a library, and nothing better to do for the next decade who wants to entertain himself.

They get to spend time in the library, get a trip to the courthouse for a change of pace ocasionally...it's a hobby for incarcerated people.

Get over the lawyer hate, at least for petty BS like this.

Hate lawyers for a real reason. Plenty exist.

Sorry my friend, but some of these scum-bag lawyers go on to represent us as president.
