    I spoke again to the LEO involved with part of the aftermath on this one. The newspaper story is wrong. According to said LEO, the guy that had the machete wounds was the guy that also had the LTC.

    He and his brother were attacked by two other brothers. The guy with the LTC shot at the BGs killing one, wounding a second. The LTC guy's brother then grabbed a knife that one of the original BGs had and stabbed him while said BG was running away from the gun.

    The story in the newspaper is a mess.

    The revised information you provide is amazing.
    As well how wrong the newspaper got things is sad, as compared to the very simple telling of the tale you have made in just a few sentences per your OP and this update.

    Per your update then the shooter, 'LTC guy', will manditorilly per MA state law be convicted of murder as we do not have a manslaughter or second degree homicide charge on our books. I'd had a long discussion and debate about this very subject last spring with the then Hampshire County ADA.
    He'll go to trial and hopefully be found not guilty on grounds of self defense, but this is MA...Anything can and does happen. :|

    As to the brother going only by your statement if the BG was fleeing and he, the brother, caught up to him as he was in flight and at that point became the _aggressor_ to which he stabbed him (lethal force). That would be in MA under state law a felony crime. :|
    Hopefully for him no flight by the attacker was involved, per witness accounts.
