(CNN) -- Three inmates were shot and wounded by guards Friday during an escape attempt at a Livingston, Texas, prison, officials said.
The incident started about 9 p.m. (10 p.m. ET) when inmates were leaving a church service at a gymnasium in the prison, said Jason Clark, a spokesman for the Texas Department of Criminal Justice.
While walking back from the church service, five inmates jumped an interior fence in an attempt to flee, officials said.
Guards opened fire, wounding three of the inmates. All five were captured and the wounded inmates were taken to a hospital, Clark said.
They don't mess around.
Question, is deadly force reasonable to stop a fleeing felon?

I don't know, but It should be.

I'm not sure this is really a "fleeing felon" situation. First off, they are in prison so the laws that might apply to "us" probably aren't applicable. Second, I'm not sure they are felons (although maybe trying to escape from prison is a felony).
I have no idea what the laws might be in this case. It does seem reasonable to assume they would be dangerous if they had actually escaped so maybe that is the rationale for shooting. I sure don't feel any sympathy for them.

Why have guard towers and armed guards if they can not shoot to stop a prison break.
Folks are not in prison because they are nice people.

I know from being a prison guard for 12 yrs not only CAN they shoot they are legally obligated TO shoot.If you fail to do so you can lose your job and the state can be held responsible for what the inmate does while out.

Interesting. Judges should be held liable when they give reduced sentences. So should people who give bail money.

In Texas, according to my nephews and nieces, who are prison guards....they have to fire a warning shot 1st....if they do not stop, then you shoot to......

They should be shot when attempting escape. They should be shot in the yards when they fight.

Distiguish between fleeing felon (generally covered by Tennessee v. Garner) where the answer is "no," except in extenuating circumstances, and fleeing convicted felon where, in GA, the answer is "yes" he may be shot if attempting to escape.
