Road Rage Motorist Shoots Bat Wielding Attacker

Not many details here, interesting if this guy will be cleared in self defense or if charges will be brought. Seems to me like the whole incident would have been avoided if he hadn't stopped after the altercation.

Law & Disorder: Road-rage motorist shoots another in Jacksonville

By The Times-UnionStory updated at 5:14 AM on Saturday, Mar. 6, 2010

A gunman shot a man who was beating his car with a baseball bat on Firestone Road in an apparent road-rage attack, Jacksonville police said Friday morning.

The victim has been hospitalized, but his injuries are not thought to be life-threatening, said Lt. R.H. Elkins of the Sheriff's Office.

The attack occurred about 8:30 a.m. at Firestone and Moses Street just east of Interstate 295 in the Sweetwater neighborhood. Both vehicles stopped following an altercation between the drivers. One driver began attacking the other's car with the bat when he was shot, Elkins said.

The unidentified victim was taken to Shands Jacksonville hospital. The gunman is in custody, Elkins said. He has also not been identified.

Yeah, why couldn't he just use the gas pedal? Sounds like he wanted a fight.

I guess I'm a little prejudice here without more data.

Interesting how the guy that got out of the car and started swinging a baseball bat at a car was listed as a "victim" and not an involved party.

Sounds like they were both looking for a fight, from the comfort of my couch.

Look for this quote in the follow-up article: "He hit my car a few times and then charged toward me with the bat. I knew I was next, so I shot him fearing for my life." You know it's coming.

I wouldn't have stopped unless I had no other choice. You never know what that other driver is going to have in his hands when he steps out of the vehicle, or how fast he can use it.

If possible he should have just driven away.

The dens in the car are not that hard to get fixed.

No matter how this case comes out the fellow with the bat will probably never hit a car again.

As of now (9:50 pm) no more details available on our local newspaper's site. We all know that there are a lot of missing details.

But, with what has been reported the guy with the bat is not a "victim" -- he is the aggressor -- and the so called "gunman" was defending himself. Typical media terminology. To repeat -- we don''t have many details yet. Facts may change our opinions.

Of course, the first sentence tells it all -- using "gunman" before any facts are available. I think we all know the negative connotation of that term.

Not always possible. Many people only put one plate on their car.
Also, the victim's car may be blocked in.

By "victim" I'm CORRECTLY referring to the person who defended himself.

...but not enough info to tell. Now both of them could have some major problems.
It's so easy to get into a 'right of way' dispute, and sometimes so difficult to drive away, but being able to drive away makes things so much easier and the situation is soon forgotten.

Brandishing and a warning shot might have worked on this one.
You may not like guns. You may choose not to own one. That is your right.
You might not believe in God. That is your choice.
However, if someone breaks into your home at 3AM the first two things you are going to do are:
    1) Call someone with a gun.
2)Pray they get there in time." - A wise man

I know how quickly tempers can flare when something happens on the road. But it's important to keep a cool head, especially when you're carrying a firearm. There's nothing wrong with getting peeved, but you must control your reaction to that emotion.

There's always that temptation to "chase" or maybe "get back" the other guy (I've almost done it a few times myself before thinking better of it and backing off...), but you just have to withdraw from things like that. Honk if you need to... show a certain finger if it really warrants it. But don't get into a car fight that turns into a real fight. It's just not worth it.

I really have to disagree here. You should never point a gun unless you intend to use it for deadly force. Hollywood takes warning shots; in real life, it's not always so convenient. That's IMHO/my $0.02 anyway.

Not enough info yet. Perhaps he DID try to get away. Perhaps the driver pulled off somewhere and parked hoping the rager would stay on and keep on going but instead the rager pulled right up on him and went to town.
