Intimidating with a gun (whether it's real or a sufficiently convincing toy) is no different than grabbing the kid by the collar and cocking your fist back. This is a bullying issue, not a "zero tolerance" issue and the offender needs to be dealt with.

    "...approached a fellow fourth-grader..."

A 12 yr old in the fourth grade? That definitely adds a dimension to the story.

Ha, ever seen a wilderness program? City kids in the woods are great. WAY out of their comfort zone. It's actually quite effective. Definitely needs something besides public school.
I prefer to live dangerously free than safely caged!

Yes, schools are authoritarian. They must be. They have custody of our children and during the time they have custody they must use their authority as a parent would to protect and to educate the children.

Now, if you are saying that your precious proton pack was confiscated by a teacher who was misguided and mistook it for something dangerous, all I can say is that such things happen in schools all the time. It goes with the authority we confer on teachers to maintain a safe and disciplined environment in which all kids can hopefully learn. I vividly recall teachers confiscating "baseball cards" because they were a source of distraction.
keep in mind this was kindergarten. On Halloween day. A day we learned nothing, just went around to higher grades trick or treating. I was the kid in a brown jump suit with a ghost buster patch. A ghost buster without a proton pack is a sad ghost buster indeed... Come to think of it that's when my life started going to ****... I'm gonna go sue now
There is something about firing 4,200 thirty millimeter rounds/min that makes me feel all warm and fuzzy inside.
