This has always been a question in my head. Why? Are they more dead? If you are justified in using lethal force, should there be anything that would be excessive? I mean, your legally allowed to kill them at that point. What's more excessive than that? Ok, I know lawyers, DA's, bla bla. And yes I can think of some things that might be excessive once the guy is down. But if they are still a threat, then all bets are off. This is more of a rhetorical question. It's what goes through my head when the excessive force argument gets thrown out.

I wonder ... does every state have statutes that cover charging perps with murder if anyone dies during the commission of their crimes, even if they weren't the ones who actually harmed the person? I'm glad to see more charges like being successfully made. The LEO providing the overview is absolutely correct: they were responsible for the crime, and everything that happens during it.
They made no mention of the staff of the store, whether they were injured or not.
Your best weapon is your brain. Don't leave home without it.
