    Angry Roommate skipped, need to get out of lease.

    Well my roommate called me and informed me that he can no longer pay rent, and will not be living with me anymore.

    Now, he is on the lease, however, my property company does not care where the money comes from, just so long as it comes.

    I can buy out of the lease for $1000, but rent is $500 a month not including electricity or internet, and I make $800 a month at my current job.

    Needless to say, I can't afford this place on my own, and this is the 12th bad roommate to date. In fact, I've never had a roommate that I could call "good".

    Late August/early September I go back to my seasonal job making almost double what I make now, but I fear that I will not be able to pay the rent until that time.

    What to do?! I guess I could pull a Seinfeld and start "The Human Fund" like George did one episode...

    EDIT: Selling my guns is not, and never will be an option!!

    Take him on judge judy,people that break leases and think they can just skip off into the sunset without repercussions need to get sued,what you have to do is try to find a roommate too mitigate your damages.

    Can you approach the property manager and explain what happened?? Not that you're planning on skipping out on the rent...but cut you a break on a month...?

    Or...maybe it's time for a second job.

    Or...sell your roommate's stuff....

    I second taking him to court....but wonder how much a filing fee, lawyer (?), and other associated costs are worth it....

    1) talk to your landlord. see if he can work with you for a short period of time until you can get something worked out
    2) small claims court. thats what it is for. dont let ppl get away with that crap
    3) fine a smaller cheaper apartment so that this doesnt happen again. it may not be great, or exactly in the location that you like, but there are apartments in the $300-$500 range in your area

    Unfortunately leases are legally binding. Your best bet is to contact the leasing agent to try to work out an agreement. If you've been a dependable client they will probably try to work with you, especially if it's a temporary setback. How about help from family?

    Well while I'm all for small claims court, it takes a long time to get a court date. I filed in July or August and got a court date for the end of October....
    Plus costs a little to file and pay the marshall to serve papers. I'm assuming that you want to come up with money to get out of the lease now???


    I don't think there is such a thing as a good roommate.
    Do you have somewhere else to move to?

    O.nce you file the claim call the number fot Judge Judy or the Peoples court,if both parties agree to it then they will take the case

    Yep. Take em to small claims court. Filing fees should be minimal and you don't need a lawyer in most cases. You'll probably win your costs too. You do have an obligation to mitigate damages....run an ad show an attempt to find a replacement diligently. He's on the lease...he's on the hook. You just have to jump through some hoops to make it right. These types of deadbeats count on others not going through the legal system to recover damages/losses. I'm no lawyer...but I think you have some recourse.

    Small claims court is not the easy answer.
    Yes, you will win, and he will get a judgment against him.
    But no one will help you collect.
    Unless you are holding something of value of his, you may be able to sell after going to court again.
    Don't expect the sheriff to knock on his door for you.

    I suspect since he can't afford rent, he doesn't have anything of value. Deadbeat.
    At least he didn't live rent free while promising to pay, "next month."

    depends on how the lease is written: are you both listed as tenants and are BOTH resposible for the entire months rent. OR are you each listed as tenants who are responsible for HALF the total rent each month personally. See a legal aide, you may not be responsible to the landlord for the ex-roommates half.

    my room mates are alcoholics, one has a drum set in the room next to mine, the other leaves beer cans and bottles in the the bathroom we share. the a/c is always on when it doesnt need to be, and im about to do dishes for the 5th time when only 1/3 of them are mine.
    oh yeah, my queen size bed takes up over half my room and i have a dog.

    room mates suck, everyone wants out, trust me.

    They may take the case. No guarantee you will get on the show and if they do pick your case, expect to wait 6 months or more to tape it.

    Don't rely in getting on TV to solve this problem.

    Hey, if nothing else works and you want to stay in the apartment, talk to your landlord and see if he'll take half rent for two months. Then you could possibly make up the $500. over a 3-5 month timetable as you'll be landing your better job in August.
