    Help! TX pharmacy problem. Any Texans know about out of state prescriptions?

    My wife is in the Austin area visiting family. She has a prescription (Class 2 narcotic) that can only be filled by a pharmacy that has a written plan for filling prescriptions for out of state prescriptions (statute 481.075). A pharmacist in the Austin area suggested that only border towns would have such a written plan.

    Anybody know a pharmacy that has this written plan closer than her having to drive across the border to Louisiana or Oklahoma?

    I thought the big 3, CVS, Walgreens, and Rite Aid, did that? If you could get it in one you could get it in all of them? Might be worth a call. Her Dr. may have to fax a prescription to a local one to get it in the system. I don't know for sure, but thought I had heard it before. It's worth a few phone calls.

    Filling out of state C2 prescriptions.

    1. Pharmacies CAN fill only NEW or ORIGINAL prescriptions from out of state physicians (as long as the doctor has a valid DEA registration number).

    2. Pharmacies CANNOT REFILL out of state prescriptions (ie. if the original was filled in Texas an out of state pharmacy cannot refill that prescription).

    3. Pharmacies CAN fill NEW TELEPHONE (phoned in) prescriptions from out of state physicians (as long as the doctor has a valid DEA registration number).

    Have the physician phone in a prescription for your wife. NO PROBLEM.

    After thinking about this for a while I decided to call Texas and speak to a pharmacist at one of the chains I used to work for.
    WOW... As he said to me "Texas is a Conservative State". They DO NOT ALLOW the filling of CONTROL DRUG prescriptions except from Texas Prescribers.

    If Texas is like CT, prescriptions for controlled drugs can't be phoned in, have to present a valid written script. Additionally CT does not allow refills for controlled drugs, need a new script every time.

    If you read the statute (481.075) you will see that they can fill these scrips IF they have a plan filed wit DPS. Unfortunately, almost no pharmacies bothered with doing it. There's one in Vernon. And one in Pflugerville let there's expire. DPS is expediting their renewal but we've found a way around the problem. It involved annoying her Doc here considerably and a lot of running around on my part. Funny how Docs are leery about writing repeat scrips for narcotics. She had to take her original scrip to a pharmacy and they had to call the Doc and tell her they were destroyed.
