    I saw that article, cracked me up. I am all for banning burritos now, especially high capacity burritos.

    Remember the old James Cagney movie where he played a gangster and smashed a grapefruit in his girlfriend's face?

    Now THAT is assault.

    A tossed burrito is rude and disturbing, but is it really a crime? They would have had to call in a SWAT team to handle the food fight on Animal House.

    i am all for being hard on domestic abuse, but really? he threw a burrito at her? it's a burrito. it's not assault. at least not by my interpretation of the law. she had food on her. pretty soon they will start filing assault charges for kids shooting unwilling participants with a nerf gun on the playground.

    he was already on probation. they didn't need to come up with a reason to cart him off to jail. a police contact warrants a call to the probation officer, who in turn could put him on a probation hold. just seems ridiculous. but as with everything else reported by the media, i am sure there are a lot of other factors that were not reported.

    Okay I'll be the bad guy on this thread. If its not a crime what is the alternative? Is it legal with no repercussions? Or are you saying that the victim should have retaliated with force and left the Government out of it?

    I often joke about the causes of such crazy stuff going on, such as mental defect, bad burrito, or whatever. Can't say I recall the last time I read about an actual "bad burrito" being used in an attack.

    Depends on the state, I'm sure. In our PC-centric culture, anything one feels is directed toward them is taken badly, it seems. I'm sure there's something under provocations, public peace or some such that covers it. After all, 20M+ statutes don't exist for nothing.

    To be fair to the facts, it appears this guy's a drunk with history, and that his 6-pint, 0.254 BAC escapade resulted in his partner being struck and her being fearful of escalation. In the military, such behavior would be a D&D, like as not. I'd say that it seems appropriate such a situation's handled more or less similarly with citizens, particularly ones with drunken history such as this guy.
