    Absolutely. On both counts.

    One would think the constitutional oaths sworn by the elected politicos and appointed jurists would be sufficient to toss such blatant attempts at constitutional evisceration out the window, but of course it'll only happen so long as we citizens keep holding their faces in the fire demanding they do their sworn duty.

    We agree that it is hard to believe that a thinking person from Texas WAS so "oblivious to the legitimate, easily-understood, commonly-known risks on such days" as to create a liability in the stadium by putting a black bench in the hot sun knowing full well the legitimate dangers involved. But believe it or not...someone in Texas put a burning hot bench out for people to sit on. Your right, that IS hard to believe.

    On this site I hear all the time how we don't need government intervention and how it's bad; but isn’t Tort reform government intervention or did I miss the in office memo that says government intervention is OK as long as it is what I believe in

    About all that can be said on that point is: those who selected the seating failed to take precautions to guard against those failing to take precautions.

    I have no doubts she will collect on her law suit and rightfully so. I also have no doubts that black chairs will no longer be located there.

    Tandy had employees working in PGH. that were moved there from the Lone Star State of Texas.

    One day I heard:

    Tort reform... Giving away your right to access the court system is taking away your constitutional rights. Why is so difficult for people to realize this?

    Goes to show when it comes to upholding the constitution some people just talk the talk but don't walk the walk. Hypocrites that support the constitution only if it 'fits' their agenda and way of thinking. They actually support government legislation that takes away our constitutional rights.

    The woman sitting on the bench or the woman who spilled the coffee certainly hold some of the blame for their injuries (culpability) BUT the extent and severity of their injuries are not 100% their fault. This need to be worked out in court and we need to retain the RIGHT to do so.
