The article stated "The man is facing public intoxication charges and breach of probation". It is not a free speech issue.

He has the right to say it. He also has the right to face public intox. charges which is why he was arrested.
Lucky for him, being a jerk is not against the law.

I have no idea on what Canada's free speech laws, or lack thereof are. That having been said, he was neither arrested for nor charged with speech violations. He was charged with good old fahion D&D and violating the terms of his parole. Unless that parole term said you can't disabuse kids of the notion that there really is a Santa, it is not a free speech issue.
