    I would say that - that cop needs to be charged with destruction of private property and theft.

    If it was against a county ordinance, the county would have to get a judgement that would levy fines against the owner until he removed it. It's a pain in the butt, but it is the proper legal channel for addressing this.

    For he sake of expediency, I can see the officer being directed to remove it. The problem is, he got caught, and what the officer did was illegal.

    It was likely a cop acting on his own - out of Dept Regs. - to help some guy he's friends with and must be against the politics of the sign himself. Since you have evidence notify the Dept. It'll stop. The last thing they want is to get involved in some legal hassle involving Freedom of Speech which they know they'd lose.

    If they say they ordered it - well forget that. It's so patently beyond the powers of Police they would know that like they know how to count to 10. (By the way, don't show them the only photo you have - and you should have and keep the original. Have a few copies made - give them one of those. Just in case)

    (These are not exactly unknown signs in NY State right now by the way. It's not like the sign advocates some bizarre off-the-page political group. Anyway, even then it would be protected.)

    IF the sign is on his property, I don't see how the town has the right to remove it.

    Some HOA's have very strict anti sign rules, but you know that going into the neighborhood. It doesn't sound like, from the article, that this is the situation.

    What if you have a sign in your yard, in December, that says, "Merry Christmas" and your neighbor is an atheist. If he complains to the town, do you have to take your sign down?

    How about a "For Sale" sign. What if your neighbor doesn't want you to sell because you're asking below market price and he doesn't want the property values to drop. Can he complain and make you take your sign down?

    This really does sound like a clear violation of the First Amendment, but it's hard to know because the article doesn't cite which law is being violated by the guys sign.

    Supreme Court?

    I deal with this crap all the time. If the county has a regulation that you must cut your lawn and you don't, they'll bring it before a local judge and a judgement will be assigned to either fine you, or cut your grass for you and bill you for it. If the county has a regulation against signage other than "Home for sale" (many do, btw), they take it before a local judge, and they start levying monthly fines against you for leaving it up. SOP.

    Think of the repercussions. There could well have been a confrontation between the two neighbors because of all this.

    If the cop was doing the right thing why didn't he tell the home owner what he was doing and why this is not right and needs to be challenged.

    Good point dave. If the cop is just enforcing the town law, he should have gone up to the guy's door and explained why the guy had to take down his sign, citing the specific ordinance. NOT stop by under cover of darkness and take the sign off the lawn.
    That is not the way law abiding, taxpaying citizens deserve to be treated.

    Pragmatic answer: They haven't changed. We've always been subject to county ordinances, zoning laws, as well as any covenant contracts that we sign when we purchase property.

    I just want acreage (preferably swamp to deter two-legged trespassers), lots of it, and zoned where I can park a tractor in my front yard and shoot off my back porch if I feel like it.
