    VENT - Colorado Dept O' Labor

    I am a field service technician for a concrete paving company. I am currently on job attached layoff until Feb 4 (was Jan 7, and has been extended twice).

    I started with this company in July of 07. As per procedure and advice from coworkers and management, I applied for unemployment on my last day (Dec 21).

    CO state law has UI (Unemployment Insurance) benefits structured that the quarter that you apply in, they go back an additional quarter and base your UI payments on your average pay for the 12 months prior to that quarter. I am OK with that.

    The problem is that the UI $$ comes from the employer that you were with in that time frame.

    In short, I applied 10 days too early.

    It was confirmed yesterday that I am not going to receive any UI $$$ because I resigned willingly from my previous employer. The fact that my current employer has been paying into UI under my name, and I am listed as job attached layoff has no bearing. I was not notified until Jan 9 that I will not be getting any $$$, and the 12 day time frame to cancel my claim had expired.

    Insult to injury, when I do return to work, if we go through another round of layoffs this season, I will still not get any $$$. This claim will last 1 calender year and I have no recourse. I can not apply and receive any $$$ until Jan '09.

    State law, State policy, and I got caught in the technicality.

    I have already notified my supervisor of the situation, and asked that I be brought back on for at least 16 hours a week so I can get something. I have enough in savings to get us (wife and I, and she is on disability) through until mid Feb then things are going to get ugly - like liquidation, pawnshop, bankruptcy ugly.

    I hate finding out the rules after the game has started.

    The last 5 years has been one incident after another, some good, some bad, and always with the water level about nose level.

    Something bad happens, we get a little break so we don't go under.

    Something good happens, it is quickly followed by bad to keep our nose under water.

    That is a real tough situation. Is there any way for them to remove your original claim? Talk to a supervisor, sometimes these people can do a little extra legwork to help someone out.

    I already tried. I am FUBAR.

    I could probably get a lawyer to get something, but that defeats the purpose.
