    California trying to ban smoking in rental property

    I just saw a clip where they are trying to pass a bill to allow landlords the option to ban smoking in their rentals,now i'm an ex-smoker I quit 15 years ago but I think these people are going too far to limit what you can do in a place you rent that is legal under the law.The next thing will be if you own a gun you can't bring it in a house or apartment you are renting,or any one of a number of things

    Smoking damages the apartment, the smell work its way into any fabric surface and never comes out. As a landlord I have no problem with banning smoking in apartments, I would never rent my apartment to a smoker who wanted to smoke inside. I can see how this argument might be used to try to prevent renting to gunowners too, but the difference is that guns don't damage the apartment unless they're used improperly. Cigarettes do.

    Rent from someone else. It's their property, not the renters. None of the apartments I used to rent allowed me to change the oil in my car out in my parking stall. I didn't make it a huge issue. Furthermore, when I rented an apartment once and it stank like cigarette smoke, I demanded and received a better apartment for the same rent. Smoking in an apartment, like smoking in a car, reduces its appeal and thereby its value.

    Why would they even need a law??? (Other than the natural CA reaction that the govt needs to get involved in everything).

    I can't believe a landlord doesn't already have the ability to include a "no smoking" clause in the lease.

    A non-smoking apartment? Well, I guess you don't have to rent it! You would certainly know ahead of signing the lease.

    I agree that a landlord has a right to exclude smokers.What else I see that has already started is this.After the government is through with smokers,they will go after fat people.After the fat people,anyone with a low IQ will be the next target.My point is,I do not believe our modern government gives a damn about health,as always,government cares about money and control.I have never heard of a county,city or state that refused tax money from cigarettes.OOPS!I think I just ranted

    I was a smoker 22 yrs ago and I don't think there should be another useless law, but I do think it should be up to the landlord. No smoking, no pets, no water-beds, whatever, it can be in the lease, but not a law. If you don't like it, don't move in. The landlord is just trying to protect their property.

    They already have banned firearms in my previous and current apartment. Needless to say, I never had/have any firearms lying around in my apartment when they come by
