Well, I'm not going to quit.
First, this is the second consecutive disturbing opinion from the robed rulers. I thought we lived in a Constitutional republic. Instead, we live in a land where five men in robes determine what we should do, how we should do it and what the punishments are if we violate the law. The Supreme Court has again overstepped its power. And people wonder why I am adamant in my posts excoriating the Court?
What should we learn from this? That there are four reasonable people on the Court and the other five that consistently are on the wrong side on the issues. It is imperative that we consider the weight of Court opinions on our every day lives, especially for those who know a child that has been raped. Those who want to sit out this election or vote for the libertarian candidate (Barr) are enabling more of these same type of despicable opinions.
The second point is that is that capital punishment has many attributes that makes it more than the ultimate punishment for the ultimate crime. It certainly provides a deterrence. To think criminals are unconcerned with consequences or getting caught is naive. It certainly provides a means that the criminal will never commit a crime again. But more than that, it provides society satisfaction. No, it is not blood lust but rather that certain crimes, such as child rape, are so offensive to our morality that it must be punished to the fullest extent. That is what we are reading from most of the responses here.

Finally, the idea that more murders will occur because the penalty is the same is simply unsubstantiated. There is no evidence to suggest that to be the case. I will probably be challenged for this but rape is a crime of sex, not primariy violence. It is a particularly violent crime but that is not the point. The point is sexual dominance and a child is absolutely the most vulnerable in society. Further, children typically make very poor witnesses in court and many times they do not even testify. I don't think we will see more child murders if we eliminate rapist scum.
Yet again, the Court's majority opinion goes against the Constitution, goes against public opinion, goes against legislated statutes, and continues to demonstrate the activist judges that have usurped the roles of the other two branches of government.
This just goes to show that we as a nation don't care about our children the way we used to, present company excluded.
This is truly sickening, but the good news is when the general population finds out what any given child predator has done their life is pretty short anyway.
I'm extremely disappointed in the SCOTUS decision on this. But if I'm around and able to intervene, then this crime will still carry the death penalty.
My argument for the death penalty involving child molestation is basically that "to understand all is to forgive all" is a load of crap. Some things, the more you understand the more you loathe.
To paraphrase Heinlein: There are only two possibilites. Either the person is so crazy that he can't be made well - in which case he's better off dead for his own sake and the safety of others - or he can be treated and made sane. In which case, how could he live with himself when he realized what he had done?
Either way, a person doing this once is way too many. We have a good way to make absolutely sure that same person doesn't do it twice, we should use it.
I take satisfaction in the fact that he just destroyed his political career. Beyond that I want to give him a swift boot to the head.
I thought this was unbelievable. Well, I guess this is what it takes to get everyone who voted for this piece of crap to see what they have done. Its a lesson for everyone.

I don't believe or care if the DP is a deterrent, for the reasons mentioned earlier. It's not supposed to be. It is the declaration that a person is unfit to live in society and his life is so vile it should be snuffed out. I'm fine with that. If it causes some people to not commit heinous crimes then that's nice, but I'm more interested in the fact that the person will not be wasting oxygen anymore.
I also don't believe there should be any such thing as a "life in prison without parole" sentence. If we have made the determination that they will NEVER be a benefit to society, I say get rid of them. Cap'n already quoted Charlie Daniels, and I think that is as good an answer as far as what to do with them as any. I figure once the alligators get full we still have plenty of options left. Nuclear Waste disposal, Medical Science;
Heck, if we could get enough of them we could finally answer the 9mm vs .45 ACP debate. Now, that would be a worthwhile ending to a worthless life.

Truth be told, if the fact that child rapists were in the midst of the prisons' general population gets leaked out, the lack of death penalty for them would be a moot point. Child rapists don't last long from what I have been told, unless they are under special protection.

I have known some jailbirds in my days working in a restaurant that hired from the work release program. Mostly petty criminals, they don't let the murderers out. One thing I learned from them is that almost any person in jail would have no qualms about torturing and killing a child molester. Even the biggest, toughest bada** in prison has a soft spot in his heart for children and no compassion for those that hurt them.
The only problem is that the wardens know this too. Pedophiles are usually isolated and protected in prison so they won't get what they deserve.
Just thinking about this makes me so angry that I've had to censor myself here. That's also why I've stayed out of this thread for so long. Few issues inflame me the way this one does.
I'll just add one last thing. A question for those that keep saying that applying the death penalty to child rape will make them kill their victims. Now that us parents know that our children's attackers will never face the death penalty and will sit in an isolated, protective cell, will more of us parents take the law into our own hands if our children are attacked?
I'm not saying that I would. That would imply premeditation. I want the temporary insanity defense to apply to me if I ever find myself in that situation. Because, most likely I would need it to stay out of jail.
Let me bring this home a bit. I received notification that a violent child sex offender just moved into my neighborhood. About 100 feet away from my front door. Convicted of violating a child pornography law. 21 years old, convicted at age 18. And I have 2 boys.
Every time I see this guy, and I will see him daily, it will be a force of will to not engage.
