Man charged with shooting lawn mower: MERGED

    Milwaukee Journal Sentinel ^ | 7-25-08 | Crocker Stephenson

FRIDAY, July 25, 2008, 11:49 a.m. By Crocker Stephenson Man charged with shooting lawn mower

Keith Walendowski Keith Walendowski is charged with shooting a lawn mower. A 57-year-old south side man, who might have been struggling with a hangover, is charged today with shooting his lawn mower with a sawed-off shotgun.

"I'll tell you the truth," a criminal complaint quotes an apparently inebriated Keith Walendowski. "I got pissed because my lawn mower wouldn't start, so I got my shotgun and shot it.

"I can do that. It's my lawn mower and my yard, so I can shoot it if I want," Walendowski told police.

Ignorance of the law, however, is not a legal defense.

Walendowski is charged with a felony count of possessing a short-barreled shotgun and a misdemeanor count of disorderly conduct while armed. If convicted of both charges, he faces up to six years and nine months in prison.

The shooting occurred Wednesday at a home Walendowski shares with his mother in the 3500 block of S. Austin St.

According to the complaint, Walendowski had been drinking all morning. Around 9:30 a.m., he attempted to start his 21-inch Lawn-Boy - unsuccessfully.

After shooting the mower, he went in his basement, where he was arrested by police, the complaint says.

Police recovered the shotgun, shells, a handgun, rounds for the handgun and a stun gun.

Dick Wagner of Wagner's Garden Mart, 6075 N. Green Bay Ave., said shooting the mower didn't help Walendowski's odds of getting it repaired.

"Anything not factory recommended would void the warranty," he said.
Yep. If the lawn mower won't start, a good ol' dose of buckshot will git 'er working.

I think this is the best part of the story. Shooting your mower with a shotgun voids your warranty. I will have to remember that next time I have trouble cranking mine.

    I like Wagner's comments too.

I've been tempted to shoot my neighbors mower before, especially when I'm working 3rd shift.

Six years in prison. Had he lined up a milk jug on the stump in the back yard, would he be on tap for 6yrs' felony punishment? Had he merely taken out a target propped up in front of the target berm? No?

Unknown if this was in a stacked-and-packed neighborhood of houses, in which case I'd think it's worth considering reckless endangerment, at worst. Otherwise, it seems awfully petty.

I believe most of the time he is facing is for possession of a short-barreled shotgun.

Yeah, well. The Ruby Ridge siege was in response to shorties, too, IIRC. Ah, the lengths to which big brother will go to ensure we're saved from ourselves ... over a couple inches and non-threatening behavior. If this is the case, it's still silly.

The Second Amendment has nothing to do with hunting. It is about keeping the government in check. This requires that the citizenry is well armed and at all times has immediate access to arms.

Six years in prison? Who is going to mow his lawn while he is there?
