    FORT SMITH - A 19-year-old Fort Smith man has been arrested after a shooting Monday afternoon.

    It happened around 2 p.m. at a house on North 40th Street. William Wright was arrested on a felony second degree battery charge after police say a handgun he and a friend were playing with went off.

    The name of the victim is not being released, but police say he was taken to the hospital with serious injuries.

    In your opinion.....is the charge of felony second degree battery appropriate? More or less?

    If they were simply "playing" with the firearm then they should both be charged with second degree stupidity, but not second degree battery.

    Now, if more to the story comes out and there are more interesting details then we'll have to revisit the stupidity charge and possibly upgrade it.

    If the facts as presented are complete and acurate, I think a felony rap is probably overkill. I have always belonged to the school of thought that criminal charges require criminal intent. I think negligence belongs in the civil/tort courtrooms.

    As to the charges at hand, the police can charge this kid all day long with watever they want to. I want to see what the DA ends up going with, if anything. -Jay

    There are actually no facts in the OP other than supposedly they were playing with a gun. Playing with a gun can cover a lot of things. Maybe they were playing Russian Roulette or William Tell?

    He'll beat that charge, because it relies on "intent" , and there was not intent to purposely injure.
