    Don't see how this is possible. Assault charges usually require the application of force or at least it's attempted application. I doubt this will get anywhere in court.

    Not always; assault is different from battery. The charge was battery on an officer. But I to doubt this will go anywhere, but thats just because I'm cynical of the courts and not because I think the charge is wrong.

    For everyones educational reading pleasure;

    Battery is committed when any person unlawfully and intentionally makes physical contact of an insulting or provoking nature with the person of another, or unlawfully and intentionally causes physical harm to another person.

    Assault is committed when any person unlawfully attempts to commit a violent injury to the person of another or unlawfully commits an act which places another in reasonable apprehension of immediately receiving a violent injury

    And before all the "Well in my state" posts roll in, those definitions are taken direct from W. Va code, the only one that matters with this story. (1. W.Va. Code §61-2-9(b) and (c).

    I cannot create gas at will, and sometimes it escapes of its own accord. Passing gas is a normal bodily function that all of us do.

    I think a reconstruction is in order.

    But you do know when its going to happen, and you didnt have to do so in the officers general direction.

    I want to know where the video of this is. I can only imaging the reaction of the person processing him. Any bets as to whether or not a cuss word or two was used in response to it. I figure it was probably a fairly confined space and not nearly as easy to get "relief" for the officer as the offender.
    Just remember that shot placement is much more important with what you carry than how big a bang you get with each trigger pull.

    Sure... if the coughing contains saliva or the criminal is trying to spread disease. The key is the intent, not necessarily the action itself. Spitting at an officer will land you in jail, as it has since the beginning of history.
