    Ark. man left the phone at a McDonald's; he's now suing for $3 million.

    FAYETTEVILLE, Ark. - Here's some food for thought: If you have nude photos of your wife on your cell phone, hang onto it.

    Phillip Sherman of Arkansas learned that lesson after he left his phone behind at a McDonald's restaurant and the photos ended up online. Now he and his wife, Tina, are suing the McDonald's Corp., the franchise owner and the store manager.

    The suit was filed Friday and seeks a jury trial and $3 million in damages for suffering, embarrassment and the cost of having to move to a new home.


    The suit says that Phillip Sherman left the phone the Fayetteville store in July and that employees promised to secure it until he returned.

    Manager Aaron Brummley declined to comment, and other company officials didn't return messages.


    Serves the idiot right. But with the way lawsuits go nowadays some jury will probably give him even more than he's asking for.

    I saw this on Yahoo local news yesterday. I thought it was so stupid I actually printed it out for the guys at work to read. Bad part is, no matter how idiotic it all sounds, I figure they are going to come away with something in the way of a cash reward for being stupid....more than likely a settlement from McD's. The thing is...since it's been brought to public light, and she admitted to sending those pics to his phone....I think she should be charged with indecent exposure, contributing to the delinquency of minors, violations of FCC communications and anything else the defense attorney can dream up! What a couple of maroons!

    An employee of the store acknowledged he/she had it and would keep it safe until he got back to retrieve it, and while in their custody it was broken into and abused in that manner? Uncertain if breaking into a private phone is an illegal act, but doing so and subsequently posting private material in a public fashion is certainly wrong. Consider the same situation if the material had been financial/documentary instead of photographic. The owner of the phone has been wronged and damaged. He's got a case, IMO. Pucker up, McD's.

    lol and how hard is it to put passwords on your phone? the couple camera phones i've had including my current one have tons of options for passwords anywhere from not being able to turn on the phone to making a call to sending a text message..currently my pictures are password protected they can spend all day trying to get to them but if they don't know the password they are screwed w/o extra help. i still remember when i used to work @ Chick fil a. i had everything password protected just for this reason because i didn't trust my co-workers and i'd be in a rush and leave the cell phone out in the open. some people just don't learn. was it wrong for the workers of the nasty food place to send them out? yeah...but again the guy should keep track of his cell phone

    Yep! It all boils down to irresponsibility once again, and someone suing someone for their own stupidity. Another reason some of my fellow Americans make me sick....literally. I'd like to be a team member, but I just can't do it as long as folks like this abound.

    Suffering? The physical and mental pain must be excruciating.

    Embarrassment? I didn;t know embarrassment was now cause for a successful civil lawsuit.

    Having to move to a new home?

    If we had a tort system that required the loser pay for court costs we would not see these idiotic and frivolous suits.

    Leave photos out in the public, someone's going to look at them. In today's electronic world, images on a cell phone are the same. If you lost them, too bad. Maybe they hit the net before the guy called and asked for the phone to be secure. Why not prosecute him for contributing to the delinquency of minors for leaving pornographic materials out in public? Fight on McD! Stupid frivolous lawsuits cost us all dearly.

    Whomever found it is probably going to countersue for 3 million for being blinded..

    Whose irresponsibility? The person who mislaid the phone, or the thieves of the material on that phone? No misplacement earns thievery and public display. If I mislay my car for an evening, forgetting where in the 50ac airport parking lot I parked it, then it gets broken into, has that been earned? Does that wholly negate the criminality that's just occurred? Is a lawsuit against the thieves "suing for one's own stupidity"?
