    The Massachusetts Senate has unanimously passed a pandemic flu preparation bill that has languished in the Legislature before the recent swine flu outbreak.

    The 36-0 vote today sends the measure to the House. Both branches have taken it up in past years, but have not been able to agree on the details.

    The new Senate version would allow the public health commissioner in a public health emergency to close or evacuate buildings, enter private property for investigations, and quarantine individuals.

    The measure also requires a registry for volunteers that would be activated in an emergency and establishes fines of up to $1,000 for not complying with local public health orders.

    Sen. Richard Moore, chair of the Health Care Financing Committee, says the swine flu outbreak provides added impetus to pass the measure.

    To the Honorable Senate and House of Representatives of the Commonwealth of Massachusetts in General Court assembled:
    The undersigned legislators and/or citizens respectfully petition for the passage of the accompanying bill:
    An Act Relative to Pandemic and Disaster Preparation and Response in the Commonwealth

    SECTION 1. Chapter 17 of the General Laws is hereby amended by striking out section 1 2A, as appearing in the 2006 Official Edition, and inserting in place thereof the following 2 section:- 3
    Section 2A. (a) Upon declaration by the governor that an emergency exists which is detrimental 4 to the public health or upon declaration of a state of emergency under chapter 639 of the acts of 5 1950, as amended, the commissioner may, during such period of emergency, take such action 6 and incur such liabilities as he or she may consider necessary to assure the maintenance of public 7 health and the prevention of disease. The commissioner may establish procedures to be followed 8 during such emergency to ensure the continuation of essential public health services and the 9 enforcement of the same.

    $1,000 fine for every day you don't "follow one of the rules" and up to 30 days in jail.

    I can't cite chapter and verse, but public health law has traditionally given the authorities tremendous amounts of leeway. And the courts have agreed.

    Folks can be taken from their homes and quarantined, they can be confined to their homes, their homes can be inspected for the presence of certain animals. Animals in the home or on their property can be inspected, seized, killed. Movement can be controlled, or permitted.

    Don't be shocked. It has been like this for decades. Remember Typhoid Mary in the early 20th century? Poor woman was locked up in isolation against her will for years. Remember the guy with drug resistant TB a couple years back?

    And at any given time there are active animal disease outbreaks being put down in which federales enter property to inspect and sometimes to order destruction of the animals. How do you suppose the "routine" outbreaks of Avian flu which happen in the poultry industry get put down; as just one example?

    yeah, its to protect the mass population. if a strong enough strain of drug resistant TB or something like that ever came about, it could wipe out an entire nation. so yeah im all for some quarntining, of infected people.

    Except it doesn't just stop at quarantine, nor does it give specifics on "infected". In reality, if things like this are allowed to pass, they could come out with a "vaccine" tomorrow, order an entire town to take the "vaccine" for public health and anyone that refused would be not only quarantined, but their homes turned upside down, fined, jailed, etc... and the list goes on.

    they have passed, as the first post proves, and im sure if you dig deep enough im sure you will find other states with similar laws.

    so you would rahter let a whole country fall when a disease could have been quarnentined to a city, or a block, or even a single house?

    First part--- Uncle and State government already have the power to demand that people get vaccinated; you know, the shots they require before you go to school, when you enter college. And if there were a major epidemic that could be slowed by mandatory shots, it could be compelled---though what is likely to happen in a major epidemic is that 95% of the folks will have the good sense to get the vaccine to protect their butts, and the other 5% are to small a fraction of the population to permit a sustainable "chain-reaction" of disease spread. So, it would be really unusual that mandatory vaccination would ever become an issue---outside of the school stuff some of which I have serious issues with; but that's for another time.

    Second part--There won't be a "experimental" vaccine used on the general population and 65% of the folks getting it getting sick ain't going to happen. Keep it in perspective.

    There is one group that does routinely receive "experimental" vaccines and does so under compulsion--- military folk. There was quite a stir about the anthrax vaccine a few years back but the courts backed the army medics.

    When push comes to shove you can bet the courts will always back the health authorities. That is called being pragmatic, and it is relying on the best expert advice that can be found.

    I didn't say that. What I'm saying is that we are effectively giving one man or a small group of men EXTREMELY overreaching and invasive powers and we need to tread VERY lightly.
