    LODI, Calif.

    When a dump truck backed into Curtis Gokey's car, he decided to sue the city for damages. Only thing is, he was the one driving the dump truck. But that minor detail didn't stop Gokey, a Lodi city employee, from filing a $3,600 claim for the December accident, even after admitting the crash was his fault.

    After the city denied that claim because Gokey was, in essence, suing himself, he and his wife, Rhonda, decided to file a new claim under her name.

    City Attorney Steve Schwabauer said this one also lacks merit because Rhonda Gokey can't sue her own husband.

    "You can sue your spouse for divorce, but you can't sue your spouse for negligence," Schwabauer said. "They're a married couple under California law. They're one entity. It's damage to community property."

    But Rhonda Gokey insisted she has "the right to sue the city because a city's vehicle damaged my private vehicle."

    In fact, her claim, currently pending at Lodi City Hall, is for an even larger amount _ $4,800.

    "I'm not as nice as my husband is," she said.

    It is unbelievable, isn't it? I saw this too and thought he should be fired because how does his boss know he didn't do it on purpose to collect some money?

    I hope her lawsuit gets tossed out like yesterday's garbage, too.

    Think about it. He hit his car (private property) with a City's truck (public) He is not in essence suing himself but the city for damages incurred when a city employee was driving the truck. If I were the judge I'd give him the second chance just because the city was stupid enough not to fire him the first time he pulled that stunt.

    Only in Kali. Obviously they need to throw in an additional suit for about $1.5 mil worth of emotional trauma. What a crock!

    Mind you, in taking up the civil court's (at least the clerk's office) time, valuable tax dollars have been already wasted by this brain-dead (and incredibly unethical) moron's attempts at cashing in.

    I say fire him and have liens placed on his personal property to reimburse the people of CA!

    Well let me put my Paralegal Hat on:

    There may possibly be a "lack of maintenance" negligence issues associated with the City's mechanical shop department and/or third party company contracted by the City that provides their mechanical service.??

    The Truck brakes or brake system/components may have been faulty or kept in unsafe condition causing lack of stopping power. ?? All this can easily be proven or ruled-out by checking maintenance records before protractive litigation ensues.

    But these issues, if any, should have been disclosed on the gentleman's Original Plaintiff's Petition.

    But if he named himself as a Defendant,....well,...some people you just can't reach!!
    What we've got here is failure to communicate.
