Rise in NM pecan theft worries farmers | Deseret News
LAS CRUCES, N.M. — Mesilla Valley pecan farmer Greg Daviet prides himself on his friendliness. But this time of year, he totes a gun around his farm and pays security guards to make the rounds through his orchards, day and night.
"I'm a friendly guy, but during pecan season, I have to walk around armed all time, so thieves know this is not a place to come," he said.

New Mexico just needs some of those TX laws deaiing with thieves.
"That I cannot do."
"Give this to, uh, Clemenza. I want reliable people, people who aren't going to be carried away. After all we're not murderers in spite of what this undertaker thinks."

Depending on NM law, if he draws his weapon on an unarmed person he could end up in big trouble. I'll admit I don't know if the threat or use of deadly force is legal to prevent theft of property there. If I were him I'd also carry a digital camera to get pictures of the thieves and their vehicle license plates.

Thats enough to make you go bananas. I'd say there's a lot of fruitcakes running around there.
Ignorance is a long way from stupid, but left unchecked, can get there real fast.

In New Mexico, you cannot use deadly force to protect property. You can only use dealdy force when you fear for your life, or that of your familys lives. You can use deadly force on your entire property/area of land, not just limited to inside your home.
This problem with the pecan owners exists in many towns/locations all over new Mexico, Roswell NM currently has the greatest amount of theft taking place, Cruses is 2nd. Applies to pistachios as well.
