    Missouri open carry question

    A friend of mine called the local Sheriff Department to ask some questions about OC. He was told that if you do not have your CC permit that if you open carry you are not allowed to have a magazine in the weapon. That you are allowed to carry the mag on you just not in the gun. Is this true? I checked the local city ordinances and couldn't find anything about it.

    Hard to answer your question. MO does not have preemption for OC. It may be a local ordinance in the jurisdiction your friend called.

    State law concerning OC is not preemptive in MO. Local laws (county, municipality, etc) can put anything on the books. Its pretty well a mess. In short, it might be correct no way to know without knowing exactly where your friend was and a good chunk of research.

    Just get the permit.

    It's such a hassle to carry without a permit, the rules can change county to county, city to city.

    There's no point in carrying an unloaded firearm anyway.

    I plan on getting the permit with my wife after we puchase her a Ruger LC9 which may be a few months down the road. Just wanted to see about OC until then.

    North KC, may be your only concern, when I worked for KCPD, our uniform & accessory store Alimar is on 210, near Burlington.
    I never gave anyone any crap, as I never saw any OC going on..But I was informed later that OC is prohibited in "North Kansas City" which is a separate municipality..

    I use a Blackhawk Drop-Rig now that I'm no longer a cop, I still go to NKC, and have never been hassled..

    DO call & verify though, this has been 7 years!

    As a Missouri Resident...

    There is no set law from municipality to municipality that will give a straight answer on OC. You may be able to in one county but the next county it is illegal and the next has a bunch of restrictions & the next anything goes. Better to just CCW than to mess with trying to get ALL the regs for each muny.

    Thanks for the help everyone. Hopefully I can get my CCW soon and not have to worry about it.

    I think that's your best bet. This way you'll know you'll be carrying legal in most areas. Don't try to mess with gun laws. You'll go nuts. Don't give antis any more reasons to protest firearms.

    Art. 1 Sec. 23 of the Missouri Constitution. OC is legal, municipal laws can prohibit OC. The only way to know for sure is to go to the City hall itself and check the laws of that City. Never, never ask a police officer. If there is no law prohibiting open carry it is "legal". another words legal except where specifically prohibited. Some cities are wll known for OC friendly, soem known for locking you up and taking your firearm. A good source to pop the question - OpenCarry.org - A Right Unexercised is a Right Lost! ... register and go to "missouri".

    Greene County Mo. Love it here.

    Except for State restrictions on carrying in courts,jails,polling stations and schools,bars(check state laws),OC is ok here loaded.You can carry concealed in your car without a CCW.Gun rack,lfully loaded,no problem.I have lived overseas and all over the USA and here in Greene County Mo i have never felt more free.A safe place for us who "cling" to our God and guns.....

    The problem referencing a county, using Greene County as a reference, is that there are 16 cities/towns within Greene County where you would have to confirm whether OC is legal or not.
