Don't mess with it. Send it right back and they will send you another new unit.
Call them first because you might need a "RA" return authorization.

They will gladly replace the unit with no hassle.

Yeah, those things, for the money especially, are supposed to be pretty darned trimmed to aim right for the guns they go into, aren't they?

I'd arrange to have it replaced. But I don't know if they're going to challenge you and ask if maybe it's your shooting that's the cause of the aim problem. I wonder if you should be prepared to field a bit of grilling about it.

Were you shooting from any kind of bench rest or handgun vise or anything, so that you can really be sure that the Lasermax is off-aim? Is it possible that anything is misaligned or malformed about the gun in which you've installed the laser?

How far off is high and to the right? Are we in silver dollar range at 7 yards and pie-plate range at 25 yards?

My expectations are lower. I thought the laser was supposed to give a simpler point and shoot capability and (maybe in a dreamworld) to provide non-lethal deterrence.

To the right is troublesome, but I wouldn't expect point of aim (laser dot) to match point of impact (bullet hole) for a pistol; here's why:

The laser points straight, and is not in the barrel. So the ballistic (parabolic) path of the bullet and the straight line of laser have to intersect at some point, perhaps (at best) at two points. In order for the laser to intersect the bullet's path at defensive pistol yardage, the laser (positioned under the barrel) must be angled upward.
