Publisher Provides Disclaimer With U.S. Constitution, Will Media Notice?
By Kyle Drennen Wed, 06/09/2010 - 16:54 ET

Copies of the U.S. Constitution put out by Wilder Publishing and being sold on Amazon.com come with an odd disclaimer on the first page of the pamphlet, in part declaring: "This book is a product of its time and does not reflect the same values as it would if it were written today."
On Wednesday's America Live on FNC, host Megyn Kelly reported the controversy, will the rest of the media follow?

In an example of political correctness run amok, the disclaimer goes on to warn parents of the literary material to follow: "Parents might wish to discuss with their children how views on race, gender, sexuality, ethnicity and interpersonal relations have changed since this book was written before allowing them to read this classic work."

The provocative pamphlet also includes the Declaration of Independence and the Articles of Confederation.

On FNC, correspondent Trace Gallagher quoted the publishing company's response to the controversy: "We specialize in classic books and we were receiving complaints about the values depicted in some of the books.

We wrote the disclaimer so that we could stop having to point out to our readers that people held different values 100 or 200 years ago.
It seems we're dammed if we do and dammed if we don't."

Kelly concluded: "You know, it's one thing when you republish 'Lady Chatterley's Lover,' it's another when you slap that thing on the U.S. Constitution and the Declaration of Independence." Gallagher mocked: "Warning Children."

Time for a boycott of Wilder, imo. That is not only ridiculous, but completely and totally unacceptable.

I wonder exactly what, in those documents, is so offensive? Worse, who are the idiot parents that find anything in the very documents that procured and secure their right to be idiots?

Warning! U.S. Constitution, Declaration of Independence and others

Is this crazy or what? hell, I had to learn the Preamble just to get out of 6th grade (I think it was sixth)....now these papers need a warning label????

FOXNews.com - Publishing Company Under Fire for Putting Warning Label on Constitution

    By Diane Macedo ------Published June 09, 2010 ---- FOXNews.com

A small publishing company is under fire after putting warning labels on copies of the U.S. Constitution, Declaration of Independence and other historical documents.

Wilder Publications warns readers of its reprints of the Constitution, the Declaration of Independence, Common Sense, the Articles of Confederation, and the Federalist Papers, among others, that “This book is a product of its time and does not reflect the same values as it would if it were written today.”

The disclaimer goes on to tell parents that they "might wish to discuss with their children how views on race, gender, sexuality, ethnicity, and interpersonal relations have changed since this book was written before allowing them to read this classic work."

Walter Olson, senior fellow at the Cato Institute, says the company may be trying to ensure that oversensitive people don't pull its works off bookstore or library shelves.

"Any idea that’s 100 years old will probably offend someone or other," Olson told FoxNews.com. "…But if there’s anything that you ought to be able to take at a first gulp for yourself and then ask your parents if you're wondering about this or that strange thing, it should be the founding documents of American history."

The warning seems to be offending more people than the documents themselves.

Amazon.com’s customer reviews of Wilder’s copy of the Constitution, the Declaration of Independence, and the Articles of Confederation show an overwhelming number of people speaking out against the disclaimer, describing it as “insulting,” “sickening” and “frankly, horrifying.”

Another review for Wilder’s edition of the Federalist Papers calls for an all-out boycott of the publisher, sarcastically pointing out the "dangerous ideas" it’s trying to protect children from: "limited government, checks and balances, constrained judicial review, dual sovereignty of states and federal government, and deliberative democracy."

And though warning labels are usually posted to protect a company from potential lawsuits, constitutional attorney Noel Francisco says this disclaimer has no legal benefits.

"Would it ever be a legal concern that selling the Constitution would expose you to some kind of liability? No. Never,” Francisco told FoxNews.com. "The Constitution is the founding document of the country, an operative legal document."

As for the idea that this warning label might help keep these works from being yanked off bookshelves, Francisco says it is more likely to have the opposite effect: people not carrying the book because it has the disclaimer.

"By putting on the warning, you’re making controversial something that’s not controversial: our Constitution, our Declaration of Independence," he said.

Amazon customers appear to agree. Almost all of the reviews discussing the disclaimer end with the same thought: don't buy from this publisher.

Efforts to reach the publisher were unsuccessful.

There is no contact information on their website. I am sending them a classic hand written letter to inform them of the atrocity they are committing with this horrid disclaimer.

This cant be allowed to go without them knowing how Americans feel.

The core message of the warning is valid--“This book is a product of its time and does not reflect the same values as it would if it were written today.”

Makes perfect sense. All three (Declaration, Constitution, Federalist Papers) are complex documents subject to various interpretive meanings, and all three are products of their own time. There isn't anything false in the disclaimer.

If you are a parent discussing portions of our Constitution, you have an obligation to discuss, for example, how ideas and attitudes about slaves, the relevant moral issues revolving around slavery (2/3 person) made sense in its day but not today. Times change, and that is much less of an issue today than in the immediate anti-bellum period. And we can go on and on with almost every element.

If you are discussing 1A, you might want to talk about the fact that it was not binding on the states at first, and states did indeed limit freedom of the press.

Or you might want to talk about the fact that Senators were not supposed to be popularly elected. Times change.

There are always folks who find reasons to be "offended" or "irritated." Getting concerned about the alleged disclaimer seems a tad wasteful of one's own energy.

Those documents aren't the literal word of G-d. And two of the three have no force of law.

Conversely, I have no problem with the disclaimer.

When the Constitution was written, women didn't have many rights. Nor did blacks, indians, hispanics, asians, etc.

So, some of the clauses in the Constitution reflect the times of when they were written. Times that were different than today. Thus, the disclaimer saying just that.

Here is the book, on Amazon.com, along with several scathing comments/reviews referencing the offending "disclaimer": click.

I wonder when they are going to start putting a "disclaimer" on the box when you buy a new United States Flag for your home?

What they did is down right offensive to me! I am literally outraged! Makes me want to...

I wonder if I can sue for being offended? Every other far left zealot does, and often times end up getting their way. Shouldn't me being offended be taken just as serious as a left wing zealots offense?

That makes me sick. It really is sad...you know that the reason that they put this disclaimer on the book is to limit their chances of having someone become "offended" and then in turn, sue them. Have we really reached this low, where people are more concerned with covering their own butt, rather then stand behind the Constitution...

This isn't a novel, it's (supposed to be) the basis for our form of government. People don't have a civic duty to research the history of an "offensive" novel; but they damn well do for this particular document.

Additionally, this is not a creative work of fiction where reprinting it *might* be seen as some kind of endorsement. This is an official government document that is in effect today. This is no different than reprinting a copy of your miranda rights.

My Disclaimer would be a bit different...

This book was a product of its time and it does not reflect the same values that it does today because modern values have been perverted. Parents might wish to explain to their children how views on race, gender, sexuality, ethinicity and interpersonal relationships have changed since this book written before allowing them to read this classic work. Parents should also explain that these classic documents were written by God-fearing and moral men that held themselves to a higher accountability, and that the concepts presented in this book may be seen as outdated, irrevelant or null and void by many people in todays society.
