    Senator Rand Paul (R-KY) has been doing a yeoman’s job of trying to rein in the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and protecting the privacy of gun owners.

    But now, according to senate insiders, the Republican leadership is trying to undermine these efforts by urging fellow Republicans to oppose Paul’s “no gun registration” amendment.

    Paul’s amendment would exempt gun records -- including 4473’s (the form all purchasers fill out when they buy a firearm from a licensed dealer) -- from the blanket information demands which the ATF can make under the 9/11 legislation.

    We have known for weeks that Senate Majority Leader Harry Reid would oppose Rand Paul. But now, Senate Minority Leader Mitch McConnell is also helping “Dirty Harry” Reid by encouraging other Senate Republicans to oppose the Paul language.

    All gun owners need to take action right now. Time is short, as the PATRIOT Act extension will become a done deal sometime tomorrow (Friday).

    So please use the Talking Points below TO CALL Senate Minority Leader Mitch McConnell today! Ask him to support the Paul amendment and to urge other Republicans to do the same.

    Even if you live in Kentucky, please make sure you call the Senator’s office, because time is short.

    TALKING POINTS FOR SENATOR McCONNELL

    1. Please urge Senator McConnell to support the Paul “no gun registration” amendment and to use his leadership position to urge other Republicans to do the same.

    2. Without the Paul “no gun registration” amendment, it is possible that the ATF could go to a secret (FISA) court and demand every 4473 in the country, ostensibly because a “terrorism investigation” requires it. If such an action were taken, the government would have a list of every gun buyer in the country going back decades.

    3. If Senator McConnell allows Harry Reid to successfully shut out gun amendments, then gun owners will hold him (McConnell) personally responsible for enabling the Majority Leader. And if the Democrats retain the control of the Senate in 2012, the Republicans will only have themselves to blame.

    4. ANSWERS TO POSSIBLE OBJECTION. Senators have been trying to tell Senator Paul (and Senator McConnell will probably tell you) that the PATRIOT Act does not allow the ATF to get every 4473 in the country. Well, there are two answers to this:

    a. First, if the PATRIOT Act does not, in fact, allow the ATF to go on fishing expeditions, then what is the harm in passing the Paul amendment? Why not just pass the Paul provision so that we can have an extra ounce of prevention specifically prohibiting the ATF from using the PATRIOT Act to fish for people’s gun sale records.

    b. Second, the very language that some Senators are claiming will protect us is the very language that the ATF is currently violating! Senators like McConnell want us to think that the 1986 McClure-Volkmer law (which outlaws gun owner registration) is good enough to protect us from fishing expeditions under the PATRIOT Act.

    But as any law school student and judge in the country knows, more recent laws (like the PATRIOT Act) ALWAYS TRUMP older laws (like the 1986 Act which prohibits gun owner registration). If there is a conflict, the more recent law governs. Hence, it’s not surprising that we are currently witnessing the ATF violate the 1986 McClure-Volkmer law, as the agency recently issued new proposed rules to require registration of those persons who purchase multiple semi-autos -- and all of this in the name of fighting gun smuggling in the Southwest.

    Too late, it's a done deal. McConnell and Kyl threw us under the bus. Only ten senators voted with us.

    Yea, I know...I saw that. It looks like we'll just have to replace all the Senators except those ten when their terms are up! I am just sooooo sick and tired of politicians with an "eliteist" attitude, WE ELECT THEM TO REPRESENT US!, and then when they get there, it doesn't matter any more what we want, they know better. They really think they know what is best for us. They treat us like we are little children, instead of doing what we elect them to do.

    Senate Rejects Efforts to Protect Gun Records from ATF
    Friday, 27 May 2011 17:23 The Senate, by an overwhelming 85-10 vote, tabled an amendment by Senator Rand Paul which would have protected 4473’s and other gun records from blanket searches by the ATF under the PATRIOT Act.

    A mere 24 hours earlier, Democratic Leader Harry Reid went through parliamentary convolutions in order to prevent a vote on the Paul 4473 amendment, fearing that a vote on his language would have devastating implications for his Democrats running for reelection.

    But Reid had some important allies in the Republican leadership. Minority Leader Mitch McConnell and his second-in-command, retiring Senator Jon Kyl (R-AZ), used their “Republican whip” apparatus to mischaracterize the Paul amendment and try to force Republicans to vote against it by spreading misinformation and lies.

    For instance, they claimed that had the FBI been investigating the 2009 Fort Hood shooter, and the Paul amendment had been in effect, authorities would not have had the necessary tools under the Patriot Act to conduct an investigation.

    But the terrorism legislation was fully in force at the time of the Fort Hood shooting, and did nothing to prevent it! The answer to every government inadequacy is not simply to grant it more power.

    Republican leaders also claimed that there was no evidence that the PATRIOT Act has been abused on a “widespread” basis, either in general or with respect to the Second Amendment.

    But given that all investigations are SECRET and it is a crime to disclose them, it is hypocritical to argue that we don’t know all the abuses.

    Here’s what we do know: First, we know of thousands of illegal phone records which were procured by the FBI.

    Second, the Obama administration is pushing to illegally seize 4473-type information through its illegal regulations on multiple semi-auto sales in the Southwest –- a demand which is being made under the rubric of “national security.” This effort to register gun sales along the border just underscores how easily the ATF could use the excuse of “terrorism” to register gun sales across the entire country.

    Opponents of the Paul amendment claimed that gun owners are protected under the PATRIOT Act, because a request for gun records must be relevant to a terrorism investigation and must first be approved by the Director of the FBI or a select few high-ranking officials.

    But this argument does not address the fact that the standard of “relevance” is a low standard ripe for abuse, and it is not much of an assurance at all when you have an administration (like Obama’s) that is hostile to the Second Amendment.

    Reid had one additional ally: the National Rifle Association. In the end, the NRA helped both Democrat and Republican leaders by not taking an "official position" on the bill.

    So the NRA cowers again.

    They're becoming part of the machine. I sometimes wonder if they are more interested in keeping the problem alive, so they can peddle for more donations.

    The push for gun registration is alive and well. Just notice how many people are here on the forum, who daily cry for more regulation.

    Registration has only one end: a disarmed populace at the mercy of those who are.

    AMEN...problem is, how to fix it. I don't know...We thought we did some good last November, then this comes up and only 10 Senators out of 100 stood with gun owners. It's disgusting, it really is. When you think of how many lives have been lost fighting to preserve our rights down through the years and then some greedy, corrupt politicians are willing to throw them away to play their childish political games. It makes me sick.

    I'm glad this passed. Now maybe gun owners will wake up a bit. Too many gun owners assume Republican = Pro gun and Democrat = Anti gun. Someone said "Republicans sold us up the river". No, POLITICIANS sold us up the river. Any politician will support anti gun legislation if it furthers their political goals and helps them get re-elected. Wake up people.
    -It is a seriously scary thought that there are subsets of American society that think being intellectual is a BAD thing...
